Local representative crisis: Access ban looms for TEMU
The process for an access ban has officially begun for the e-commerce platform TEMU, which has failed to appoint a local representative in accordance with the Ministry of Trade's new regulation. As sanctions are being implemented for platforms that do not comply with the regulation that came into effect on April 1, TEMU's legal process is being closely monitored.
The Ministry of Trade will apply to the Information and Communication Technologies Authority (BTK) for e-commerce platforms that have not appointed a representative. The BTK will forward this application to the Access Providers Association. According to the report by Hürriyet, the decision will be submitted to the Criminal Court of Peace within 24 hours, and the ruling will be announced within 48 hours. Companies subject to an access ban will have a seven-day right to appeal.
WHAT DOES THE REGULATION INTRODUCE?
The new regulation was prepared specifically for the inspection of imported products and the protection of public health. The "Regulation on Market Surveillance and Inspection of Products Offered to the Market via Remote Communication Tools," which came into effect on April 1, mandates the presence of a local representative for products that do not have a manufacturer in Turkey.
MINISTRY CONTINUES IDENTIFICATION AND INSPECTION
The Ministry of Trade continues its inspection efforts to identify platforms that do not comply with the rule. Legal proceedings will be initiated for companies in a similar situation, starting with TEMU. Furthermore, along with complaints, reports, and field inspections, inspection practices will also be implemented in import transactions when necessary.
