Electric scooter regulation published in the Official Gazette: Fines increased significantly

A new regulation regarding electric scooter operations has been published in the Official Gazette. Prepared by the Ministry of Transport and Infrastructure, the Ministry of Environment, Urbanization and Climate Change, and the Ministry of Interior, the regulation amendment has redefined the administrative fines to be applied to shared e-scooter operators.

According to the regulation, shared e-scooter operations can only be conducted by natural or legal persons who have obtained an authorization certificate and the relevant shared e-scooter permit. The administrative fine for businesses operating in violation of these authorizations and obligations has been increased from 10 thousand TL to 86 thousand 900 TL.

The fine stipulated for businesses that violate certain operational obligations has also been increased. The administrative fine, which was previously applied as 1 thousand TL, has been set at 8 thousand 687 TL under the new regulation.

A tiered penalty system will be applied if authorization certificate holders exceed the total number of e-scooter permits they have obtained for the province in which they operate. In this context, an administrative fine of 8 thousand 687 TL will be imposed for the first violation, 86 thousand 900 TL for the second violation, and 170 thousand TL for the third violation.

The regulation also includes an obligation for operators to maintain a call center or a mobile application used for the same purpose, capable of providing 24/7 service to their users. Failure to comply with this obligation will result in an administrative fine of 43 thousand 447 TL.

The fine for businesses that do not provide the necessary information and documents during inspections has been set at 50 thousand TL. In the event of a third violation, in addition to the administrative fine, operations under the authorization certificate will be temporarily suspended for 6 months.

The regulation entered into force as of the date of its publication. Its provisions will be executed jointly by the Minister of Transport and Infrastructure, the Minister of Environment, Urbanization and Climate Change, and the Minister of Interior.
