Nicaragua files lawsuit against Germany for 'supporting Israel'

Nicaragua has filed a lawsuit against Germany at the International Court of Justice (ICJ), requesting the issuance of provisional measures on the grounds that it has "facilitated the commission of genocide" by providing political, financial, and military support to Israel's actions in Gaza.

In a written statement issued by the ICJ, it was announced that Nicaragua had filed a lawsuit against Germany.

According to the statement, Nicaragua accused Germany of failing to fulfill its international obligations in the occupied Palestinian territories, particularly in the Gaza Strip.

In its application to the Court, Nicaragua argued that by providing political, financial, and military support to Israel, and by cutting funding to the United Nations Relief and Works Agency for Palestine Refugees in the Near East (UNRWA), Germany "has facilitated the commission of genocide by Israel and, in any case, has failed to fulfill its obligation to do everything possible to prevent genocide." made the accusation.

Nicaragua argued that by supporting Israel, Germany has acted in violation of the 1948 Convention on the Prevention and Punishment of the Crime of Genocide (Genocide Convention), the 1949 Geneva Conventions and their Additional Protocols, the inalienable principles of international humanitarian law, and other general norms of international law.

Pointing to the "risk of an approved genocide against the Palestinian people in the Gaza Strip" since October 2023, Nicaragua reminded that "every country that is a party to the Genocide Convention is obligated under the convention to do everything possible to prevent the commission of this crime."

In accordance with Article 41 of the ICJ Statute and Articles 73, 74, and 75 of its Rules of Court, Nicaragua requested that the Court issue provisional measures on the grounds that "Germany is participating in the ongoing potential genocide in the Gaza Strip and in serious violations of international humanitarian law and other peremptory norms of general international law."
