A falling of leaves on social media
A transformation is taking place in politics and the judiciary. Everyone is in a great hurry. Instead of operating through bureaucracy, a style of politics that is unrecorded, unaccountable, fast, and result-oriented is being pursued.
The situation in the judiciary is no different. While the politicization of the judiciary continues at full speed, it has gone off the rails. It is now consuming the judiciary as well.
In recent days, there has been a "falling of leaves" on social media, especially on the X platform. Many accounts are being blocked from access within Turkey. The archives of these accounts are disappearing. X, perhaps the only effective medium where the public can receive news, is becoming impoverished.
Accounts were being closed before as well. However, in the past, closures carried out via the BTK (Information and Communication Technologies Authority) based on court orders have been replaced by closures carried out by the Cyber Security Presidency without any court order. As such, the restriction of freedom of expression is being carried out not by the courts, but by the discretion of the administration.
In left-wing/social democratic circles, a fantasy of a "state of law" drowned in liberal rhetoric was dominant. According to this fantasy, law and legislation were separate. There was an ideal law, and that law had to be defended. The state was to be shaped according to that law. Those holding this view referred to deviations from the state of law as a "state of legislation," speaking of the illegality of the laws in force.
And then, we even began to miss the state of legislation. Even the government's proposals to change laws began to lose their meaning. The effort to change the law by a political entity that does not comply with existing laws was, beyond being meaningless, a new way of conducting politics.
They have now figured out how to pass laws so as not to be limited by the law. What is the need for days of meticulous work to restrict rights under constitutional protection by law? Instead, it was possible to establish a unit that could do this as it pleased on behalf of the administration and shelve freedoms at will. This possibility has been put into practice.
Now, individuals whose access to their social media accounts is blocked will have to apply to the administration and file a lawsuit in an administrative court; provided they have the time, the money, and the lawyers to undertake this "futile" effort...
Actually, one should just relax. "Someone" knows something. Laws, struggles, freedom of expression... What is the need for them! Obey and be at ease! If this is what is desired, let us speak openly and reach an agreement. Let us learn who to obey and how, so that no one is later put on trial for obeying the wrong person.
