Can Atalay's 'constitutional crisis' statement: It is a matter of the parliament's law

Following his election as a Hatay MP from the Workers' Party of Turkey (TİP), the Constitutional Court's (AYM) ruling regarding Can Atalay, who was sentenced in the Gezi Park trial, has been published in the Official Gazette. The AYM stated in the Official Gazette that the decision to revoke Can Atalay's parliamentary membership is null and void. Following the ruling, Can Atalay, who is currently in prison, said he expects to be released. Atalay interpreted the revocation of his parliamentary membership as a 'constitutional crisis.'

In his statement, Atalay said, "Despite the clear provisions of the Constitution that leave no room for doubt, they 'revoked' the parliamentary membership of an elected deputy with 'non-existent provisions' and 'impossible procedures.' They made the Grand National Assembly of Turkey a partner in the blatant violation of the Constitution. My reaction and objection are not only to the injustice I have suffered but also to the 'constitutional crisis' inflicted upon our country. I have been concerned for my country about the damage that this state of lawlessness, where it is impossible to foresee who will use which right or authority and how, will cause to the nation."

'IT IS A MATTER OF THE PARLIAMENT'S LAW'

Atalay's statement on the matter via his X account is as follows:

"I find the Constitutional Court's decision to once again bring the development back to the ground of law very important for both myself and my country. Those who have even a shred of respect for the national will and democracy, however crippled it may be, should not cause any more harm to the country. It is now a matter of the parliament's law. It is now a matter of the parliament's dignity. It is now a matter of objecting to the parliament being forced to take action by instruction.

'I EXPECT TO BE RELEASED'

"I expect the Constitutional Court's ruling to be implemented immediately to return to the rule of law, for the clear provisions of the Constitution to be applied, for my parliamentary status, which I never considered lost, to be recognized once again, and for me to be released as a natural consequence of the successive rulings of rights violations issued in my case.

I reiterate: I expect the requirements of the Constitutional Court's ruling to be implemented urgently, for there to be no further resistance to the clear provisions of the Constitution, and for all procedures regarding my parliamentary membership, which has been determined to have never actually been revoked, to be fulfilled as a natural and mandatory consequence of the Constitutional Court's three rulings on the subject."
