Day 8 of the 'Newborn Gang' trial: 'Doğukan Taşçı said, "You'll kill them early, the problem will be solved"'
The trial of the defendants accused of causing infant deaths in private hospitals and generating illicit profits, known publicly as the "newborn gang," continued. On the 8th day of the trial, non-detained defendant Dr. Şeyhmus Çelik described the death of a baby with heart disease in his defense. Çelik stated, "No hospital would accept this baby because they had no money. I heard Hakan Doğukan tell Fırat Sarı, 'Don't bother with this patient, it's a waste of time.' Doğukan Taşçı was saying, 'You'll kill them early, the problem will be solved.'" The hearing will continue tomorrow at 09:30.

In the session held yesterday for the "Newborn Gang" trial, which has shaken Turkey, 7 non-detained defendants presented their defenses. While allegations regarding the death of baby Halime and the negligence during the care of infants were debated in court, the defendants' statements drew attention.
'NURSES PERFORMED THE INTERVENTION'
Responding to the allegations regarding the death of baby Halime, non-detained defendant nurse Ecem Koç stated in her defense, "The baby was in very poor condition and was intubated. Since there was no doctor present, we, as nurses, had to perform the intervention."
'PRESSURE TO ALTER EPICRISIS'
Nurse Serenay Şenkalaycı, one of the defendants, alleged that doctor Fırat Sarı, who is accused of being the gang leader, asked her to alter epicrisis reports. Stating that she refused this request, Şenkalaycı claimed that she reported the matter to the hospital administration.
CONFESSIONS FROM CHIEF PHYSICIANS
Prof. Dr. Fetin Rüştü Yıldız, Chief Physician of Avcılar Hospital, which is owned by former Minister of Health Mehmet Müezzinoğlu, also made statements regarding the details of the agreement. Prof. Dr. Yıldız said, "We agreed on the basis of receiving a 35 percent share of the turnover, not a fixed payment."
Cafer Akdur, Chief Physician of Bağcılar Medilife Hospital, also presented his defense in court. Providing detailed information regarding the allegations, Akdur claimed that the accusations were baseless.
The lawyer for Prof. Dr. Fetin Rüştü Yıldız, meanwhile, accused Prosecutor Yavuz Engin of remaining a bystander to the deaths of 10 babies and failing to take the necessary steps.
WHO PRESENTED THEIR DEFENSE IN YESTERDAY'S HEARING
The defendants whose defenses were heard in yesterday's session were as follows:
Ecem Koç (Nurse): Stated that they were forced to intervene with baby Halime because there was no doctor present.
Serenay Şenkalaycı (Nurse): Said that she refused the request to alter the epicrisis report and reported it to the management.
Prof. Dr. Fetin Rüştü Yıldız (Chief Physician of Avcılar Hospital): Provided information regarding the hospital agreement.
Cafer Akdur (Chief Physician of Bağcılar Medilife): Denied the accusations.
Tuğba Baş (Nurse): Provided a detailed defense.
Sümeyye Özdemir (Medical Secretary): Presented her defense regarding her scope of duty.
Dr. Mehmet Salih Kara, who had previously provided a defense, stated that he would not repeat his previous statements.
18 DEFENDANTS TO BE HEARD IN COURT TODAY
In today's session of the trial, the remaining 18 defendants are expected to continue their defenses. As the court proceeds with the defendants' claims and striking testimonies, the case is being closely followed by a wide segment of the public.
TRIAL HAS BEGUN
The 8th day of the Newborn Gang trial has begun.
To date, a total of 29 defendants, 22 of whom are in custody and 7 of whom are being tried without arrest, have been brought to trial.
Today's hearing began with the testimony of Ceren Hatice Kırım, a nurse at Beylikdüzü Medilife Hospital who is being tried without arrest.
“THE NUMBER OF PATIENTS SHOULD HAVE BEEN 23”
The presiding judge read the transcript of a wiretapped conversation with Fırat Sarı.
Ceren Hatice Kırım: I am speaking sarcastically in that conversation. The reason I was giving him information there was because there were too many patients in the area. There were 27 patients, but there should have been 23.
PROSECUTOR: CONTRARY TO THE NATURAL FLOW OF LIFE
Prosecutor Kadir Kocakaya: You tell Hasan Basri regarding the medication, 'Let me give you 6 of those.' There is quite a lot of conversation. But here you say, 'I didn't do it.' Why would you write down the details of a conversation about something you didn't do?
Ceren Hatice Kırım: Hasan Basri insisted on that matter a bit. Later, I spoke with the doctors and stalled him.
Prosecutor Kadir Kocakaya: Why do you feel the need to stall? It is contrary to the ordinary flow of life. If someone said to me, 'Give me this computer,' I would say, 'What are you talking about, this is state property.'
Ceren Hatice Kırım: Perhaps I dragged it out because I thought he might want it for an emergency. I thought a child might be in need. I already asked about it in the conversations.
HE REQUESTED IT FOR Fırat Sarı
Fırat Sarı's lawyer: When Hasan Basri asked you for medication, was he asking for it on his own behalf, or was he asking for it because Fırat Sarı was going to collect it at the center?
Ceren Hatice Kırım: I never heard of anything like a general center, but he was asking for it on behalf of Fırat Sarı.
'I LOVED TOUCHING THE PATIENTS'
Lawyer: Did you receive a warning from the head nurse?
Ceren Hatice Kırım: I received a warning for not auditing the files sufficiently. I already quit being a head nurse because I prefer working directly with patients.
Lawyer: From whom did you receive the instruction while distributing money related to the Medisense company?
Ceren Hatice Kırım: This was not an instruction, it was a request. He did not have an assistant, and it was something I did for a temporary period.
I was not happy about this either. It will be seen when my phone records are examined. I had served as a senior nurse. If I received anything, it was for that, nothing else.
Ahmet Atilla Yılmaz, the chief physician of Medilife Beylikdüzü Hospital, who resigned from his position as an Istanbul Metropolitan Municipality (İBB) council member after his name was mentioned in the newborn gang investigation, took the stand.
'THANK GOD I AM NOT RESPONSIBLE FOR THE DEATHS'
Presiding Judge: Will you present your defense?
Ahmet Atilla Yılmaz: I will present my defense.
Thank God I am not accused of the deaths of the babies. As a father of 4 daughters, I am grateful that such an accusation does not exist. Beylikdüzü Medilife is a hospital that is well-regarded in its region, especially with the number of births reaching 250-300 per month. We already have 7 pediatricians at our hospital. However, working in the neonatal unit is not very easy. It might be possible for 1-2 years, but it is not a long-term job. We wanted to receive consultancy because good service is very important. We also, especially in a hospital with a high number of births, needed a good physician.
It is important to have a physician who is always reachable. I did not make the agreement, but even if I had, it would have been for an important service.
The thing that saddens me the most is perhaps what the healthcare workers I know very closely have experienced because of us.
'I HAD TOLD THE MANAGEMENT'
Court President: What is the difference between Beylikdüzü Medilife and Bağcılar?
Ahmet Atilla Yılmaz: Their managements and operations are different. We have no organic connection. After the management transfer, the names remained the same, but their management institutions are very different.
Court President: Who conducted the meetings regarding the consultancy?
Ahmet Atilla Yılmaz: I also conduct them when necessary. During this process, I had told the management that we needed a knowledgeable physician regarding a neonatologist and that we should receive consultancy. Our chairman of the board, Dr. Osman Deniz, conducted it.
'I KNOW Fırat Sarı'
Presiding Judge: Who do you know?
Ahmet Atilla Yılmaz: I know Fırat Sarı and İlker Gönenli.
Presiding Judge: Did you have any consultations?
Ahmet Atilla Yılmaz: I would talk to Doctor İlker from time to time. For me, the most important thing is patient safety and treatment.
I also remember my conversation with Mr. İlker. I told him that the admission processes were important.
“WE HAVE NO KNOWLEDGE OF PAYMENTS”
Presiding Judge: Do you have any information regarding patient transfers?
Ahmet Atilla Yılmaz: I saw our own patients coming to the intensive care unit. I did not see many transfers coming from outside. We also do not easily transfer patients out.
Presiding Judge: Do you know the content of the agreement with the consulting firm?
Ahmet Atilla Yılmaz: I know that we do not have an official agreement. Payments to our employees are not within our knowledge. Overtime wages were also paid by the hospital.
Presiding Judge: There is the Opera baby. It was transferred from your hospital to Birinci.
Ahmet Atilla Yılmaz: Transfers are a process carried out by physicians in their own course. That baby came to our hospital on January 14. At 1 a.m., a need for pediatric intensive care arose as required. Since we did not have a pediatric intensive care unit, the transfer took place, but they did not withdraw their support. The physicians followed up. It had to be taken into the neonatal intensive care unit. It was followed up there as well. Sometimes, when I make a transfer and do not receive a response from 112 in a sufficient time, we call our relatives, spouses, and friends. Outside of 112, physicians, employees, and health units communicate with each other. However, ultimately, it is done when the instruction to transfer comes from 112.
“I WOULD LIKE TO THANK”
Presiding Judge: Is there anything you would like to add?
Ahmet Atilla Yılmaz: I would like to thank you. We had difficulty finding a lawyer. I would like to thank the defense attorneys very much. I never rejected any patient because they had AIDS or anything else. That is why I would like to thank you.
Cross-examination began.
Member judge: Did you receive consultancy services from anyone before Fırat Sarı?
Ahmet Atilla Yılmaz: Not in neonatology. There were in other units.
Member judge: Was there a request for a transfer?
Ahmet Atilla Yılmaz: We had no such request.
NO OFFICIAL AGREEMENT
Prosecutor Kadir Kocakaya:
You said there was no official agreement, right? On what basis are you making payments when there is no agreement? On what basis are you recording the discharge?
Ahmet Atilla Yılmaz: It doesn't matter whether it's official or not.
Prosecutor Kadir Kocakaya: How do you manage the cash outflow? You have to tax it eventually. Don't they ask during audits who these people are and what they do?
Ahmet Atilla Yılmaz: I am not the person to answer that.
Prosecutor Kadir Kocakaya: How do you receive your salary?
Ahmet Atilla Yılmaz: There are two types of salary systems: one is insured, the other is through the company.
Prosecutor Kadir Kocakaya: How do you receive it? Don't drag it out! Is it fixed or variable?
Ahmet Atilla Yılmaz: Variable.
Prosecutor Kadir Kocakaya: Do you get a bonus when the turnover increases?
Ahmet Atilla Yılmaz: No.
I HAVE NO KNOWLEDGE OF THE BABY BEING BROUGHT IN
Prosecutor Kadir Kocakaya: Do you have no knowledge of whether Fırat Sarı brought in babies?
Lawyer (objected): My client is not involved.
Presiding Judge: It has been decided that the question may be asked.
Ahmet Atilla Yılmaz: I have no information. I also have no such request.
Prosecutor Kadir Kocakaya: Did your employees provide you with information?
Ahmet Atilla Yılmaz: No.
Prosecutor Kadir Kocakaya: The neonatal unit is a closed box. I believe it needs to be inspected more strictly. How do you conduct the inspections here? There is an allegation that babies were admitted beyond capacity.
Lawyer (objected): There is no such allegation.
Presiding Judge: It has been decided that the question may be asked.
Ahmet Atilla Yılmaz: Inspections are carried out very frequently. There are definitely things we identify.
Prosecutor Kadir Kocakaya: Is there an inspection mechanism you have personally commissioned?
Ahmet Atilla Yılmaz: The people we work with are already colleagues we trust. I do not send anyone extra; that would be contrary to the workflow. We have inspection mechanisms that are sometimes announced and sometimes unannounced.
PROSECUTOR: DO NOT QUESTION MY INTENTIONS
Lawyer for İlker Gönenli: You were asked about the legislation regarding your internal operations; is that within your scope of duty?
Ahmet Atilla Yılmaz: I am sure the prosecutor asked out of good intentions.
Prosecutor Kadir Kocakaya: Do not interpret my intentions.
Prosecutor Kadir Kocakaya: Are you aware of the money the nurses under your supervision received from Medisense?
Ahmet Atilla Yılmaz: No.
Prosecutor Kadir Kocakaya: They said, 'We thought it was coming from the hospital.'
Ahmet Atilla Yılmaz: Nurse Ceren did not say that.
Prosecutor Kadir Kocakaya: I am asking regarding those who testified in this manner yesterday.
Ahmet Atilla Yılmaz: No.
MINISTRY OF HEALTH FOUND NO IRREGULARITIES
Lawyer Burak Mengü: "Did the hospital pass Ministry of Health inspections?"
Chief Physician Ahmet Atilla Yılmaz: "Multiple times."
Burak Mengü: "Were any irregularities detected?"
Chief Physician Ahmet Atilla Yılmaz: "No."
Ayşe Gizem Büyükköleş, an intensive care nurse at the first hospital, was brought to the defendant's stand.
She stated that she did not accept the statements she gave to law enforcement.
'20 THOUSAND TL TO BE COLLECTED PER DAY'
Gizem Büyükköleş is speaking about the baby named Opera:
Tuğçe Toptemel said that this baby was older.
Hakan Doğukan says something in his diary about 20,000 TL being collected. I don't know how much was collected. I had 4 patients including the baby Opera. They handed them over saying the patient had no problems. But if they had handed them over in good health, they wouldn't have been intubated.
“THEY DID NOT SEND IT EVEN THOUGH THEY KNEW THE BABY WAS IN BAD CONDITION”
Ayşe Gizem Büyükköleş: Tuğçe Toptemel called Doğukan about the baby Opera. Doğukan wanted us to check the blood sugar, but Tuğçe wanted to take a blood gas sample, but we couldn't take a blood gas sample. We looked for a probe because the monitor was faulty. They didn't send us a probe even though they knew the baby was in bad condition.
Doğukan said don't do anything, but Tuğçe Toptemel went out.
Our shift ended at 8, but we were there until 9. If they had received the baby as deceased during the day, they wouldn't have accepted it anyway.
Şehmuz Çelik would never come to the area until Doğukan Taşcı left. None of them mentioned this either. There would be no doctor in the area at night.
Presiding Judge: Do you know Hakan Doğukan?
Ayşe Gizem Büyükköleş: Yes, he was the area supervisor.
Presiding Judge: How long did you work there?
Ayşe Gizem Büyükköleş: I worked for 8-9 months.
Presiding Judge: Who did you consult when there was a problem with a baby?
Ayşe Gizem Büyükköleş: I would call the person in my own area. They would then call the area supervisor.
Presiding Judge: Who admitted the Opera baby when it first arrived?
Ayşe Gizem Büyükköleş: I don't know. My shift starts at 18:00, and the baby arrived at 16:00. I heard that Doğukan admitted the baby.
Presiding Judge: Did you hear anything regarding Fırat Sarı?
Ayşe Gizem Büyükköleş: I know he gave his approval.
Presiding Judge: Şehmuz Çelik?
Ayşe Gizem Büyükköleş: Şehmuz Çelik didn't get very involved, and I don't think he had knowledge about the patients.
PRESIDING JUDGE REACTS
Presiding Judge: Were stamps being used?
Ayşe Gizem Büyükköleş: I don't know, but it was constantly being talked about.
Presiding Judge: Whoever we ask, they don't know anything. The nurse says 'the doctor knows,' the doctor says 'ask the chief physician.' I don't understand, how did you manage these hospitals like this?
Presiding Judge: There is mention of 20,000 TL?
Ayşe Gizem Büyükköleş: After taking over the shift that day, what I heard was that 20,000 TL was going to be taken. I think that's why they were paying attention to it. My friend who worked during the day told me that Şeyhmus Çelik had panicked and said, 'Give the 20,000 TL to the family.'
Presiding Judge: Who was the one telling you this?
Ayşe Gizem Büyükköleş: Yaren.
Presiding Judge: Who knew about the 20,000 TL?
Ayşe Gizem Büyükköleş: I believe everyone working during the day knew about it.
LACK OF EQUIPMENT
'We would take the babies who were in bad condition in front of us'
Presiding Judge: Who was aware of the 20,000 TL?
Ayşe Gizem Büyükköleş: I believe everyone working the day shift was aware.
Presiding Judge: You said the monitors were not good.
Ayşe Gizem Büyükköleş: Our monitors were not very reliable. Monitors were attached to the critical patients. There were many patients in the area. We would place the patients in critical condition directly in front of us. We did not rely on the monitors much.
Presiding Judge: Were they not inspecting the monitors?
Ayşe Gizem Büyükköleş: Were the items needing maintenance kept separately? I don't know what happened.
Presiding Judge: Why should Esmeron not have been administered?
Ayşe Gizem Büyükköleş: I don't know.
Presiding Judge: You need to know why Esmeron is or is not given to that baby; you haven't understood the logic. If you always do things without knowing, you are working by rote. Otherwise, you cannot go beyond the answer of 'I don't know.'
HOSPITAL OWNER QUESTIONED
Prosecutor Kadir Kocakaya: What did you mean by your statement to law enforcement, 'Fırat Sarı works in the newborn unit'?
Ayşe Gizem Büyükköleş: When a patient's condition worsened at night, Fırat Sarı would be notified.
Prosecutor Kadir Kocakaya: Some nurses said, 'We distributed the money we received to other nurses.' Did you receive any?
Ayşe Gizem Büyükköleş: No, I did not receive any under any circumstances.
Prosecutor Kadir Kocakaya: Do you know Ali Aksu (the hospital owner)?
Ayşe Gizem Büyükköleş: I have heard the name.
Prosecutor: Was Ali Aksu aware of the Opara baby being there?
Ayşe Gizem Büyükköleş: I don't know.
Lawyer for the Ministry of Family and Social Services: What exactly is the monitor deficiency?
Ayşe Gizem Büyükköleş: Not all of them were working very reliably.
Lawyer: How long did this malfunction persist? Did you report it to the administrative supervisor?
Ayşe Gizem Büyükköleş: I did not report it myself; it was a situation already reported by my area supervisor.
Lawyer for the Ministry of Family and Social Services: What exactly is the monitor deficiency?
Ayşe Gizem Büyükköleş: Not all of them were working very reliably.
Lawyer: How long did this situation of not working continue? Did you report it to the administrative supervisor?
Ayşe Gizem Büyükköleş: I did not report it myself; it was a situation already reported by my area supervisor.
A 45-minute break was given in the Newborn Gang trial. After the break, doctor Şehmuz Çelik, who is alleged to have not gone to the hospital and to have constantly allowed his stamp to be used, will take the stand.
The break in the hearing has ended. The court panel has taken its place.
Non-detained defendant Specialist Dr. Şeyhmus Çelik has taken the stand.
“MAY GOD BLESS THE PROSECUTOR”
Şeyhmus Çelik is reading his defense from a paper.
May God bless the prosecutor who conducted this investigation.
I have been a doctor for 38 years. I have worked everywhere in Turkey except for Central Anatolia. I do not accept the accusations brought against me.
I LEARNED HE CALLED ME AN IDIOT
Dr. Şeyhmus Çelik: Hakan Doğukan Taşçı, who was brought into the position by Fırat Sarı, did not come to work properly and neglected his duties. When I called him on days he arrived late, he would say, 'I'm busy, do the rounds with another nurse.' I learned that in one conversation, he said, 'Dr. Şeyhmus screwed me over, Dr. Şeyhmus is an idiot.'
Fırat Sarı, for his part, was already saying, 'Şeyhmus is going to go.' Hakan Doğukan Taşçı and Hasan Basri Gök introduced themselves as 'Dr. Şeyhmus' and transferred the babies they received to other hospitals in exchange for payment.
Dr. Şeyhmus Çelik is speaking regarding the money transfers:
“Fırat Sarı paid a total of 40,600 TL, which was my unpaid one-month salary when I left Duygu Hospital.
35,000 TL was money I borrowed and then returned.
I do not recall these 3 transfers, which total 29,600.”
"I COMPLAINED TO Fırat Sarı"
Dr. Şeyhmus Çelik: Even though I complained about Hakan Doğukan Taşçı to Fırat Sarı, he continued his duties.
I have not gained any personal benefit from any patient.
A patient comes from Birinci Hospital; Hasan Basri called Emine Avcı and told her there was a commission. I have never been part of any organization in my life.
I did not commit intentional homicide through negligence. I am someone who fulfills my working hours. I do my rounds every morning and have the nurses take notes. I delegate to the head nurses.
Since my keyboard skills are not good, I had the nurses enter the epicrises.
Dr. Şeyhmus Çelik is speaking about the Serdorova baby:
First, they came from the Health Directorate to inspect the neonatal intensive care unit at Birinci Hospital. I explained the situation to an authorized woman there. I told her that a baby from Turkmenistan had a heart condition, had no financial means, and would die if not operated on. She said, 'Okay, I will help, I will convey it to the Health Directorate.' However, there was no response from there. The baby stayed in the hospital, no one took it. Even if the family took it, where would they have taken it?
I repeat, may God bless the Prosecutor and the police. I saw it in the wiretaps; Hakan Doğukan Taşçı said, 'Fırat Sarı, don't bother with this patient.' It is clearly seen in the wiretaps that Hasan Basri Gök also knew about this incident.
Dr. Şeyhmus Çelik speaks about the Serdorova baby:
First, they came from the Health Directorate to inspect the neonatal intensive care unit of Birinci Hospital. I explained the situation to a woman in charge there.

“I WILL NO LONGER WORK IN NEONATAL CARE”
Presiding Judge: Did you never hear that your name was being used?
Dr. Şeyhmus Çelik: No, I did not hear it. He is a high school graduate anyway; if they asked him two or three questions at the hospital, he wouldn't be able to answer the third one. Neonatal intensive care is over for me, I will not work in it anymore.
Presiding Judge: Whether you will work or not, I don't know; I suppose you will retire.
Presiding Judge: Were you writing epicrises?
Dr. Şeyhmus Çelik: I did not write epicrises. I had also undergone surgery and cannot use my right hand very well. We would do rounds, and I would have the notes taken. Then they would be uploaded. I would sign them.
Presiding Judge: Does the signature belong to you?
Dr. Şeyhmus Çelik: Yes, I would sign them.
“I HOPE THE MINISTRY OF HEALTH APPOINTS A DOCTOR”
Presiding Judge: Asked about a wiretap recording regarding Hakan Doğukan using Şeyhmus Çelik's stamp.
Dr. Şeyhmus Çelik: It is related to the Opera baby. My phone is on 24/7. If he had called, he would have reached me. I am a neonatologist, and the baby that arrived was a 6-month-old baby.
Presiding Judge: Who was looking after them when there was an emergency?
Dr. Şeyhmus Çelik: I was looking after them during the day.
I hope the Ministry of Health will now assign a doctor to every newborn, both day and night, from now on.
“I WAS SHOCKED WHEN I SAW THE TAPES”
Presiding Judge: Hasan Basri also introduces himself as Dr. Şeyhmus.
Dr. Şeyhmus Çelik: I saw it in the tapes and was shocked. Neither Hasan Basri nor Hakan Doğukan are people I like. They are irresponsible. They are just high school graduates anyway. What does it mean to say 'I am Dr. Şeyhmus'?
Presiding Judge: You called Hakan Doğukan a 'simple high school graduate.' However, Hakan Doğukan says, 'I have 20 nurses working under me.' You complained to Fırat Sarı, but you couldn't get someone you consider simple removed from the hospital by a full-fledged doctor.
Dr. Şeyhmus Çelik: When I called Fırat Sarı, I had complained about Hakan Doğukan.
Hakan Doğukan calls and says 'yeees my deaaar,' but when I call, he doesn't answer me. I leave this to your discretion.
WE TRUSTED THE HOSPITALS, UNFORTUNATELY
Presiding Judge: Was your stamp used like this?
Dr. Şeyhmus Çelik: Stamps are used like this in hospitals anyway. We trusted the hospitals, but unfortunately.
Presiding Judge: Did it not cause any problems before?
Dr. Şeyhmus Çelik's response was inaudible.
Presiding Judge: Do you have any knowledge regarding your stamp being used without your consent?
Dr. Şeyhmus Çelik: No.
Associate Judge: Did Fırat Sarı and İlker mediate your employment at Güney Hospital?
Dr. Şeyhmus Çelik: No.
Member Judge: Were they at the first hospital?
Dr. Şeyhmus Çelik: No.
Member Judge: Were you ever called regarding patients in intensive care outside of your working hours?
Dr. Şeyhmus Çelik: No.
Member Judge: Who did they call?
Dr. Şeyhmus Çelik: I don't know.
THERE WERE PATIENTS I WAS SUSPICIOUS OF
Member Judge: In what situations would you call Fırat Sarı?
Dr. Şeyhmus Çelik: I wouldn't call Fırat Sarı or Mr. İlker very often. I would call Hayrettin Yıldız more.
Member Judge: Did you witness such a dialogue between Fırat and Doğukan regarding patients with longer hospital stays, or did you not notice?
Dr. Şeyhmus Çelik: There were already patients I was suspicious of.
Member Judge: Who were you telling?
Dr. Şeyhmus Çelik: I was telling Hakan Doğukan.
Member Judge: Aren't you the one who is supposed to discharge them?
Dr. Şeyhmus Çelik: He would say, 'I'll send them out.'
Member judge: If you discharge them, shouldn't they have been released?
Dr. Şeyhmus Çelik: I was already saying that.
Prosecutor Kadir Kocakaya: Why is Hakan Doğukan making such accusations against you?
Dr. Şeyhmus Çelik: I am a disciplined man, whereas he wouldn't show up for work. He relied on Fırat Sarı.
Prosecutor Kadir Kocakaya: Nurse Ayşe Gizem also said about you that 'He didn't come to the hospital much.'
Dr. Şeyhmus Çelik: No, how could such a thing be possible? What do you mean by not coming? Let them check the hospital cameras.
Prosecutor Kadir Kocakaya: Wait, I'm going to ask something else.
Why is Ayşe Gizem making such an accusation?
Dr. Şeyhmus Çelik: I don't know why he said that.
“HE WAS LISTENING TO Fırat Sarı”
Lawyer for baby Ayaz's father, Erhan Karaduman: Was Hakan Doğukan following someone else's orders, not yours?
Dr. Şeyhmus Çelik: He was listening to Fırat Sarı. When I call, he doesn't answer my phone. He already says 'Yes sir, my dear' to Hakan Doğukan.
The hearing resumed after a 20-minute break.
Non-detained defendant Gözde Kul Yadigar has arrived.
Presiding Judge: Will you present your defense?
Gözde Kul Yadigar:
I will give the same statement here that I gave to law enforcement. I am a high school graduate and have two children. I live in Yakuplu. I started working because I had to. First, I worked as an assistant in the Chest Diseases department at Birinci Hospital. Later, after an argument with the doctor there, I moved to the Pediatric Diseases department. Then, Emine Avcı sent me to the Internal Medicine department. I was subjected to mobbing during this process. They wouldn't even give me leave when my uncle died.
Since my husband worked as a driver and I had two children, I had to work. I was subjected to a lot of mobbing by Emine Avcı. I continued in the Internal Medicine department, then when the secretary of the Newborn unit left, Emine Avcı directed me there. Ms. Cansu (I don't know exactly who she is) helped me a lot.
I worked at the hospital for 4 years, the last 1.5 years of which I spent in the Newborn unit at Birinci Hospital. We had a WhatsApp group there. I would organize the paperwork and enter the documents regarding the babies into the system. Ms. Cansu added me to that WhatsApp group.
The process didn't just work with 112; there was a system called EMT. Gıyasettin and Mr. Fehmi were there. It was said there: 'This patient will stay for this many weeks.' It was also approved in the WhatsApp group. Mr. Şeyhmus would not write the epicrisis list. Ms. Cansu (Cansu Akyıldırım) would write the epicrisis according to the stages, and I would enter what she wrote into the system.
Şeyhmus Çelik would ask Ms. Cansu if a visit was necessary. Then he would go up to his room; he wasn't seen around much. Fırat Sarı would always come to our hospital. Cansu Akyıldırım took very good care of the babies. She knew every detail of the babies' tests.
I saw Gıyasettin once. I gave the babies' stage list once, and then I gave it to Mr. Fehmi once. Hasan Basri was our area manager. Hasan Basri was always creating chaos. After him, Hasan Doğukan came; Fırat Sarı brought him.
Doğukan was given the following task: The Social Security Institution (SGK) audit began. Doğukan started acting strangely. Doğukan held a meeting with us, saying that the management was aware. He told me, 'Take this list, print the epicrisis list.' And I printed it. After the SGK audits, he couldn't do the work properly. Saying 'Management decided this,' he had the bed occupancy list checked. I told my family: 'I am a high school graduate, but I am not stupid.' I told my mother that strange things were happening at the hospital and I started collecting evidence.
"I wondered, 'Are they defrauding the Social Security Institution (SGK)?' Because there were always torn bedsheet lists on the floors. Hasan Doğukan and Hasan Basri were writing the epicrisis reports. Şeyhmus Çelik never wrote them. Şeyhmus Çelik is lying because his ID number and password were on the barcode machine. The barcode room was on the first floor, and the password was also on the barcode device."
I was writing detailed emails to Cansu Akyıldırım about the babies and the bedsheet lists. I was preparing the templates, and Hasan Basri was preparing the epicrisis reports. I was subjected to a lot of mobbing, so I started collecting evidence. Blood gas results were being torn out of the files.
The hearing, which began at 10:15 with the defense of non-detained defendant Hatice Kırım, concluded at 19:20 with the defense of non-detained defendant Gözde Fulya Yadigar.
On the eighth day of the trial, following the testimonies of the non-detained defendants, the hearing was adjourned until 9:30 tomorrow.
