New development in the Dilan and Engin Polat neighbor dispute case: Prosecutor changes opinion
The public prosecutor has changed their final opinion in the case where Dilan and Engin Polat are being tried following a dispute with their neighbors.
Following a parking dispute on June 2, 2023, between Dilan Polat and Engin Polat and their neighbors, the neighbors M.S.A. and E.A. filed a complaint against the Polat couple.
The Anatolian Chief Public Prosecutor's Office had filed a lawsuit demanding up to 8 years and 4 months in prison for Dilan Polat on charges of 'insult', 'simple assault', and 'threat', and up to 11 years in prison for defendant Engin Polat on charges of 'insult', 'simple assault', 'threat', and 'violation of residential immunity'.
Defendants Dilan Polat and Engin Polat, as well as complainants M.S.A. and E.A., did not attend the hearing held at the Anatolian 35th Criminal Court of First Instance. The lawyers for both parties were present in the courtroom.
PROSECUTOR CHANGES OPINION
During the hearing, the public prosecutor, who had presented their opinion in the previous session, had requested that the charges of "insult", "threat", and "intentional injury" against defendant Engin Polat regarding the victim M.S.A. be dropped due to the withdrawal of the complaint and reconciliation. The prosecutor had also stated that the charge of "violation of residential immunity" was not subject to reconciliation or complaint, and that it was established that he had entered the victims' residence at night without their consent, requesting a prison sentence of up to 3 years.
In the hearing, the public prosecutor, who modified their opinion, requested that defendant Engin Polat be punished for the crime of "violation of residential immunity" while also requesting a criminal complaint be filed against defendant Dilan Polat and unknown defendants for the same crime.
The hearing was adjourned to allow time for the defense attorneys to present their arguments on the merits.
