New 'extraordinary appeal' application from Kavala

Gezi prisoner Osman Kavala has filed another application following his previous request for an extraordinary appeal (kanun yararına bozma) submitted through his lawyers. The stated rationale for Kavala's application is to pave the way for normalization in the country's legal sphere and to contribute to a general improvement in this regard.

New 'extraordinary appeal' application from Kavala

Businessperson Osman Kavala, who was sentenced to life imprisonment in the Gezi Park Trial, has filed another application following the rejection of his previous request for an extraordinary appeal submitted through his lawyer, Hilal Zengin.

According to a report by Can Bursalı from Gazete Duvar, the reasons for Kavala's new application include the following statements: "It is to pave the way for the normalization of our country in the legal field, to contribute to a general improvement in this sense, and to make a small contribution, if any, to our President Mr. Recep Tayyip Erdoğan's struggle against crypto-structures. The meaning of this sentence will be better understood in time."

Following the previous rejection, Zengin wrote another petition on July 8 and applied to the Ministry of Justice General Directorate of Criminal Affairs. In Zengin's petition, it was pointed out that Kavala did not take part in the organization of any mass protests, did not provide financing, and made efforts for the Gezi protests to conclude with a consensus, stating, "MASAK records are also in this direction. Moreover, the institution that would know the client's situation best is the National Intelligence Organization (MİT)."

The petition, which states, "Osman Kavala is a clean citizen of the Republic of Turkey. Contrary to the perception that is sought to be created, our client Osman Kavala is not a political or military spy," also explained the reason for providing detailed explanations in the application as follows:

"The reason we made these explanations in our retrial application is to pave the way for the normalization of our country in the legal field, to contribute to a general improvement in this sense, and to make a small contribution, if any, to our President Mr. Recep Tayyip Erdoğan's struggle against crypto-structures. The meaning of this sentence will be better understood in time. However, it is hoped that those in positions of responsibility will not remain indifferent to this process, which will further increase the courage of true patriots. In this respect, it is self-evident that a great duty falls upon our Minister of Justice, who is a jurist."

In the conclusion of the petition, a retrial, Kavala's release, and his acquittal were requested, and it was demanded that a copy of the petition be submitted to the Presidency to ask whether they have any complaints. The application made by Kavala through his lawyer Zengin concluded with the following statements:

"It has become necessary to request, if possible, that a written opinion be obtained primarily regarding whether the old government system, the parliamentary system, has been incorporated into the new system in some way, whether it is being kept alive secretly, and whether the Council of Ministers still exists, in terms of revealing the truth."
