Notable ruling in the Aziz İhsan Aktaş case: Concordat terminated
While the "Aziz İhsan Aktaş Criminal Organization Case" continues, the concordat process regarding Aktaş's company, Bilginay Temizlik Hizmetleri, has ended following the court's decision to accept a waiver; all protective measures on the company have been lifted.
As the hearings for the case known in the public eye as the "Aziz İhsan Aktaş Criminal Organization Case," which involves 200 defendants including 7 CHP mayors—5 of whom are currently in custody—enter their second week, a significant legal development has occurred regarding Bilginay Temizlik Hizmetleri Ltd. Şti., a company owned by Aktaş.
The Ankara 3rd Commercial Court of First Instance has announced its final decision regarding the concordat file being processed for the company. Accordingly, the concordat request was rejected due to a waiver, and the process has officially ended.
COURT DECISION ON WAIVER
According to reports by halktv.com.tr; the Ankara 3rd Commercial Court of First Instance issued its ruling on January 29, 2026, in case file number 2025/226. The court ruled that the concordat request filed by the creditor Arslancan Kurumsal Ltd. Şti. was rejected due to the plaintiff's waiver.
With this decision, it was also ordered that all protective measures applied within the scope of the file be lifted.
FINAL GRACE PERIOD CANCELLED
The "Final Grace Period" decision previously granted to the company, which was scheduled to last until June 19, 2026, has been cancelled. The court ordered the removal of all preliminary injunctions on Bilginay Temizlik Hizmetleri and the notification of the relevant institutions regarding the situation.
Furthermore, the duties of the Board of Concordat Commissioners, which was tasked with managing the concordat process, have been terminated.
CONCORDAT ENDED 5 MONTHS EARLY
The concordat process for Bilginay Temizlik Hizmetleri began with a 3-month temporary grace period granted on March 19, 2025. Following examinations, the court had granted the company a 1-year final grace period effective from June 19, 2025.
The concordat protection, which was expected to last until June 2026 under normal circumstances, ended approximately 5 months early with the waiver decision dated January 29, 2026.
COMPANY RETURNED TO NORMAL OPERATIONS
With the court's decision, the concordat protection provisions regulated under articles 294, 295, 296, and 297 of the Enforcement and Bankruptcy Law have lost their validity for the company.
Thus, Bilginay Temizlik Hizmetleri has exited concordat status and returned to its normal commercial and legal obligations. The path has also been cleared for the company, which is under the management of the Savings Deposit Insurance Fund (TMSF), to participate in tenders again following the decision.
