Osman Kavala files application to the Ministry of Justice

Osman Kavala, who was convicted in the Gezi Park protests case, has now filed a request for a "reversal in favor of the law" with the Ministry of Justice following the rejection of his retrial request.

In the petition submitted to the Istanbul 13th High Criminal Court to be forwarded to the ministry by Osman Kavala's lawyer Hilal Zengin, it was requested that the verdict against Kavala be reversed in favor of the law.

The court sent the file to the Istanbul Chief Public Prosecutor's Office Ministry Correspondence Bureau to be forwarded to the Ministry of Justice's General Directorate of Criminal Affairs.

The letter sent from the court to the correspondence bureau stated: "Since the convict Mehmet Osman Kavala's defense attorney, Hilal Zengin, has filed a request for reversal in favor of the law with a petition dated 06.05.2024, the file is sent in its scanned form and physically as an attachment to our letter for examination."

BACKGROUND OF THE CASE

The Istanbul 13th High Criminal Court had sentenced Osman Kavala to aggravated life imprisonment for "attempting to overthrow the Government of the Republic of Turkey" and acquitted him of the charge of "political or military espionage."

The 3rd Criminal Chamber of the Istanbul Regional Court of Justice, which conducted the appellate review of the case, found the local court's decision to be in accordance with the law. The 3rd Criminal Chamber of the Court of Cassation, which conducted the appeal review of the file, upheld the conviction against Kavala on September 28, 2023.

Kavala's "retrial" request, made on April 30, had been unanimously rejected by the Istanbul 13th High Criminal Court.
