Released 3 days ago: Arrest warrant issued for Enver Altaylı's son-in-law Metin Can Yılmaz

The retrial of Metin Can Yılmaz, the son-in-law of former intelligence officer Enver Altaylı, on charges of "membership in an armed terrorist organization" was heard by the Ankara 16th High Criminal Court. At the end of the trial, Yılmaz was sentenced to 12 years in prison for FETÖ membership. Yılmaz, who was acquitted of espionage charges, was ordered to be released under judicial control, taking into account the time he had already spent in prison.

Following the decision, the Ankara Chief Public Prosecutor's Office appealed Yılmaz's release, and a higher court subsequently issued an arrest warrant for him.

Regarding the decision issued against the defendant Metin Can Yılmaz, his wife, lawyer Dilara Yılmaz, stated: "My husband, Metin Can Yılmaz, who has been detained for 7 years, was released with the verdict on July 24. The prosecutor appealed this. Today, the Ankara 17th High Criminal Court issued another arrest warrant. There is no valid legal reason for an arrest. As for the claim of flight risk, he went to the police station today to sign in."

WHAT HAPPENED?

Metin Can Yılmaz was tried in the same case as his father-in-law, Enver Altaylı.

The indictment alleged that Altaylı and his son-in-law Yılmaz attempted to smuggle Mehmet Barıner, one of the defendants in the case who had previously worked at the Iran desk, out of the country to manipulate the Halkbank case in the US. During the 7th hearing held on June 17, 2020, Yılmaz requested the recusal of the judge, and later made a second recusal request. After the 16th High Criminal Court rejected the request, the objection was sent to the Ankara 17th Criminal Court for a final decision; the court ruled that Yılmaz's recusal request was "intended to delay the trial" and did not find the request justified. Yılmaz's file was separated on October 26, 2020. The Ankara 16th High Criminal Court sentenced Yılmaz to 12 years in prison for "membership in an armed terrorist organization." While the Ankara Regional Court of Justice found this decision to be in accordance with the law, the decision was overturned by the Court of Cassation following an appeal review. In the retrial held after the reversal on procedural grounds, Yılmaz was sentenced to 12 years in prison for FETÖ membership, while he was acquitted of the espionage charge. Along with the verdict, it was decided that Yılmaz would be released due to the time he had already served in prison.
