New era for DASK policies in home sales: Unused premiums will be refunded
With the regulation published in the Official Gazette, unused premiums from the DASK policy belonging to the former owner of a sold residence will be refunded.
A new regulation concerning home sales has come into effect for compulsory earthquake insurance. Accordingly, if a residence with a DASK policy is sold, the former owner's policy will terminate as of the date of the title deed registration. The premium amount corresponding to the unused days of the policy will be refunded to the policyholder.
The process for the regulation began with an application made to the Ombudsman Institution (KDK). The citizen who filed the application stated that they sold their house a few months after taking out compulsory earthquake insurance, and that the new homeowner had a new DASK policy issued for the same residence while taking out a housing loan.
Stating that two separate policies were thus created for the same residence, the citizen expressed that they wanted to cancel their old policy and get back the unused portion of the premium they had paid, but encountered difficulties in the process.
Following its investigation, the KDK issued a recommendation decision to the Insurance and Private Pension Regulation and Supervision Agency (SEDDK) and the Turkish Catastrophe Insurance Pool (DASK) to review the current practice and establish a system where citizens can exercise their rights more easily.
Following the recommendation decision, legislative work was carried out by the SEDDK. With the completion of the work, the prepared regulation was published in the Official Gazette dated August 21, 2026. In the new system, it will be essential for the person who acquires the residence to have a separate DASK policy.
