The indictment prepared regarding the death of 2-year-old Baby Sıla, who lost her life due to sexual abuse and battery in Tekirdağ, has revealed the mother's negligence and the grave crimes of the suspects in detail. The indictment states that although the mother knew her two-year-old baby had been beaten on September 2 and saw the marks of the battery on the baby's body, she left her back in the same house on September 5.
The indictment prepared regarding the death of 2-year-old baby Sıla, who passed away in the hospital where she was taken after being subjected to sexual abuse and battery in Tekirdağ, states that the baby had been beaten previously at the neighbor's house where she was left by her mother.
Details regarding the incident were included in two separate indictments prepared for the children and adults involved in the baby Sıla case. In the indictment prepared for the children involved in the crime, 13-year-old K.A. and 14-year-old G.K., it was stated that the suspect children admitted to the allegation of sexual abuse.
The indictment also included information that K.A. took baby Sıla down to the coal cellar while they were at their home and beat her, and that baby Sıla became ill after the beating.
It was stated that K.A. recounted beating baby Sıla with a stick, later bringing the unconscious Sıla from the coal cellar into the house and having her smell onions and cologne to wake her up, and that the mother, B.Y., took Sıla to the hospital after this incident.
'BLUNT HEAD TRAUMA'
In the forensic medicine opinion included in the indictment, prepared by the Istanbul 1st Forensic Medicine Specialized Board, it was noted that the baby's death "occurred as a result of intracranial hemorrhage due to blunt head trauma, that there was a causal link between the injury the child was subjected to on September 8 due to blunt head trauma and her death, and that there was no other common cause for the child's death other than the injury she was subjected to due to blunt head trauma."
The indictment prepared for the adults also included the allegation, complainant statements, suspect defenses, witness statements, forensic, psychologist, doctor, crime scene investigation, digital material examination, and autopsy reports.
The indictment explained that the mother, B.Y., worked at a nightclub in the Malkara district and left her 2-year-old daughter, Sıla, and 5-year-old daughter, A.Y., with their neighbor, the suspect K.A., during the time she was working.
Stating that the mother continued to leave her daughters at this residence despite baby Sıla being beaten there, the indictment noted: "Although she was a two-year-old baby, she left the baby many times with the suspect K.A. and her children, and despite knowing that the victim baby was beaten on September 2, 2024, without any protection, and seeing the marks of the battery on the victim baby's body, she left her at the residence of the suspect K.A. and her children again on September 5, 2024."
The indictment, which explains that the mother caused baby Sıla's death by failing to perform the behaviors expected of a mother, which include the care and protection obligation arising from the law towards her victim daughter, made the following assessment:
"The behaviors neglected by the mother caused the events that resulted in baby Sıla's death, because if the suspect had made the necessary inquiries regarding the abuse act that baby Sıla was subjected to before being killed and had made the necessary complaints, had not consented to baby Sıla being beaten, and with all this, had not constantly left a two-year-old baby in a house where there were people she did not know at all and with whom she had no degree of closeness, these acts that baby Sıla was subjected to might not have happened."
In the assessment made regarding 32-year-old K.A., the father of one of the children involved in the crime, it was stated that although K.A. claimed he did not have contact with baby Sıla for sexual purposes or otherwise, the obtained forensic medicine reports and DNA samples revealed that the suspect committed the crimes of "sexual abuse and depriving a person of liberty for sexual purposes by using force against a child."
REQUESTED SENTENCES
The indictment prepared by the Tekirdağ Chief Public Prosecutor's Office against the 29-year-old mother B.Y., the neighbor K.A., who is the father of one of the children, and 57-year-old S.Ö., with whom the mother lived, was accepted by the Tekirdağ 3rd High Criminal Court, while the indictment against the children involved in the crime, G.K. and K.A., was accepted by the Tekirdağ 2nd High Criminal Court.
In the indictment, a total of 67 years of imprisonment was requested for the mother, B.Y., for the crimes of "intentional killing by negligent behavior," "destroying, concealing, or altering evidence of a crime," and "violation of the obligation arising from family law."
A total of 28 years and 6 months of imprisonment was requested for K.A., the father of one of the children involved in the crime, for the crimes of "sexual abuse of a child" and "deprivation of liberty," and 1 year and 6 months of imprisonment was requested for S.Ö., with whom the mother B.Y. lived, for the crime of "failure to report and concealing a crime."
For G.K., one of the children involved in the crime, a total of 66 years was requested for the crimes of "qualified sexual abuse of a child" and "deprivation of liberty," while for K.A., 48 years was requested for "qualified sexual abuse" and "deprivation of liberty," along with an aggravated life sentence for the crime of "intentional killing."
TRIAL WILL BEGIN ON DECEMBER 26
5 people, including the baby's mother, were arrested in connection with the incident.
The mother, B.Y., who lived in the Malkara district, took her daughter Sıla to the Malkara State Hospital on September 8, stating that she would not wake up. During the examination, the baby was referred to the Tekirdağ Dr. İsmail Fehmi Cumalıoğlu City Hospital with a diagnosis of brain hemorrhage and suspicion of sexual abuse, and the police were informed.
The baby was taken to intensive care intubated after brain surgery.
Within the scope of the investigation, mother B.Y., S.Ö. with whom she lived, their neighbor K.A., and his 13-year-old son K.A. and 14-year-old G.K. were detained, and the suspects were arrested by the judgeship they were brought before. Baby Sıla's 5-year-old sister, A.Y., was also taken under state protection.
Tekirdağ Bar Association President Gürcün had stated that it was determined by a forensic medicine report that the 2-year-old baby girl, who was brought to the hospital due to battery and was continuing treatment in intensive care, had been sexually abused.
Baby Sıla passed away on October 7 at the Tekirdağ Dr. İsmail Fehmi Cumalıoğlu City Hospital, where she had been under treatment for one month.
