A new decision has been reached in the legal process concerning the film "İki Gözüm Ahmet," which depicts the life of artist Ahmet Kaya. The Court of Cassation has overturned the decision of the Istanbul Regional Court of Justice, which had rejected the request to halt the film's screening.
Ahmet Kaya's family had applied to the judiciary, stating that the film, which was planned for release in 2020, was prepared without their consent. In their application, they had requested an injunction to prevent the film's screening.
During the process, an injunction was initially issued regarding the film, but the Istanbul Civil Court of First Instance later lifted this measure. Gülten Kaya, Ahmet Kaya's wife and a songwriter, had taken the file to a higher court following that decision.
The Istanbul Regional Court of Justice had rejected the injunction request, assessing that the film was an anonymous work. The Court of Cassation, which reviewed the file, overturned this decision, paving the way for the dispute to be re-examined.
In its ruling, the Court of Cassation highlighted that the film was prepared without the consent of Ahmet Kaya's family and that the production included fictional characters and events related to the artist's private life. The decision noted that there was no overriding public interest to justify the portrayal of his private life in the film.
The High Court further emphasized that the fictional scenes could harm the personal rights of the Kaya family and that the right to respect for private life must be observed. Following the reversal decision, the case regarding the film "İki Gözüm Ahmet" will be retried at the Istanbul Civil Court of First Instance.
