Changes to the TSK Personnel Law published in the Official Gazette
The law regarding amendments to the Turkish Armed Forces (TSK) Personnel Law has been published in the Official Gazette.
With the decision published in the Official Gazette, the costs for the provision of goods and services requested by public administrations within the scope of the general budget will be transferred to the relevant accounts of the Ministry of National Defense budget for use by the General Directorate of Mapping.
The costs for the provision of goods and services requested by administrations with special budgets and other public administrations will be deposited into the collection account of the accounting unit that carries out the accounting services of the General Directorate of Mapping. In determining the authorities authorized to grant investigation permission, conduct investigations, and initiate prosecutions regarding the Chief of General Staff, the commanders of the Land, Naval, and Air Forces, as well as generals and admirals, the final ranks and duties of the individuals concerned will be taken as the basis.
It will be prohibited for TSK personnel to publish or disclose their identities, duties, or activities through radio, television, internet, social media, newspapers, magazines, books, and all other media outlets, as well as any kind of written, visual, auditory, and electronic mass communication tools, except in cases authorized by the Ministry of National Defense. In line with the Constitutional Court's decision, in order to ensure legal security and predictability within the scope of the right to request the protection of private life, preventive searches may be conducted upon the written order of a military unit commander, military institution head, head of legal services, or unit chief in cases where there is a risk of delay, provided that the search is submitted for judicial approval within 24 hours, for the purpose of preventing danger or the commission of a crime.
Officers and non-commissioned officers who leave the TSK or are discharged before completing their mandatory service obligation—excluding those who receive a health report stating "cannot serve in the TSK" or those who leave the TSK as duty-disabled—will be required to pay twice the amount of the education, training, and development costs incurred after their appointment as military students, officers, or non-commissioned officers, as determined annually by the force commands, the Gendarmerie General Command, and the Coast Guard Command. Furthermore, those discharged for committing the act of "making indiscipline a habit," as regulated in the relevant provision of the Turkish Armed Forces Disciplinary Law, will be required to pay four times the determined costs, proportional to the remaining part of their obligation period, along with legal interest as compensation.
The status of "reserve non-commissioned officer" has been added to the Military Service Law. With this provision, the allowance to be paid to non-commissioned officer candidates during their basic training has been set as the salary of a non-commissioned officer (astsubay astçavuş), the lowest non-commissioned officer rank, instead of the salary of a specialist corporal.
Those who are re-appointed as pilot officers and leave after completing their obligation period may be granted lump-sum payments and additional compensation for the flights they have actually performed; those who wish to continue their service as active-duty pilot officers will be subject to provisions similar to their peers regarding the entitlement to flight compensation. For those who leave the TSK after completing the obligation period determined for pilots, a lump-sum payment will be made for flight hours up to 80 hours in the period between the beginning of their last year of service and the date of their departure, including offset applications, and additional compensation at a rate of 14 percent of the flight compensation will be paid for each flight hour exceeding 80 hours, not to exceed a total of 120 hours.
