Critical decision from the ECHR for Osman Kavala: The date has been set

The Grand Chamber of the European Court of Human Rights (ECHR) will announce its decision on the second application of Osman Kavala, who has been in prison since 2017, on August 25.

The ruling to be delivered in the "Kavala v. Türkiye (no. 2)" case covers allegations of violations regarding Kavala's detention process following the 2019 ECHR ruling and the trial that concluded with an aggravated life sentence.

In his application, Kavala argued that the articles of the European Convention on Human Rights concerning the right to liberty and security, the right to a fair trial, the principle of no punishment without law, freedom of expression, freedom of assembly and association, and the prohibition of inhuman and degrading treatment were violated.

The application also argued that Article 18, which prohibits the use of restrictions on rights and freedoms in the Convention for purposes other than those prescribed, was violated.

In 2019, the ECHR ruled that Kavala's detention was unlawful and that he should be released. However, Kavala was not released. In 2022, the Grand Chamber ruled that Türkiye had failed to fulfill its obligation to comply with that decision.

During the judicial process in Türkiye, Kavala was sentenced to aggravated life imprisonment on April 25, 2022, for "attempting to overthrow the government" in connection with the Gezi Park protests. The decision was upheld by the Court of Cassation in 2023 and became final.

The Grand Chamber held the hearing regarding Kavala's second application in Strasbourg on March 25. The decision is expected to be announced tomorrow at 10:00 AM in a public session at the Human Rights Building in Strasbourg.
