Remarkable 'judicial control' statement from Feti Yıldız! 'Instead of arrest...'

MHP Deputy Chairman Feti Yıldız drew attention to the judicial control measure applied as an alternative to arrest in criminal proceedings in a post he shared on social media.

In his statement, Yıldız said, "In an investigation conducted due to a crime, if there is a reason for arrest based on concrete evidence showing the existence of strong suspicion of a crime; if the purpose can be achieved with another judicial measure, a 'judicial control decision' can be issued instead of arresting the suspect for any crime, without any penalty limit."

Emphasizing that judicial control serves the same goal as the arrest measure, Yıldız stated that this practice aims to prevent the suspect or defendant from fleeing and tampering with evidence. Yıldız also expressed that it is possible through judicial control to ensure the healthy progress of the trial process and to guarantee the execution of the judgment to be rendered at the end of the proceedings.

Yıldız also reminded that the decision on whether to apply judicial control is entirely at the discretion of the judge.

MHP's Yıldız included the following statements in his social media post:

“In an investigation conducted due to a crime,

a ‘judicial control decision’ can be issued instead of arresting the suspect for any crime, without any penalty limit.

The purpose of judicial control measures is the same as the purpose of the arrest protection measure,

to ensure that the trial can be conducted in a healthy manner by preventing the suspect or defendant from fleeing and tampering with evidence

and to make the execution of the decision to be rendered at the end of the trial possible.

The judicial control decision is at the discretion of the judge.

Since the judicial control measure acts as an alternative to the arrest measure, judicial control measures should be resorted to as much as possible, given that the arrest measure is a last resort.

The institution of judicial control is a modern institution in the nature of a protection measure that has been introduced into the Turkish criminal justice system with the Criminal Procedure Code, which has effectiveness between release and arrest.

With this institution, while the person is not completely deprived of their freedom, they are subject to measures that allow for observation and supervision, thus reducing the risk of the person fleeing while eliminating the harms of being completely deprived of their freedom.”
