He had been acquitted: Hezbollah member Şakir Kaçmaz wins compensation
Şakir Kaçmaz, a member of Hezbollah whose life sentence was upheld by the Court of Cassation and who was later acquitted following a retrial, won 844 thousand 832 Turkish Lira in compensation in a lawsuit he filed for wrongful imprisonment. However, the appellate court overturned the decision, finding the compensation amount to be excessive.
Şakir Kaçmaz, who was sentenced to life imprisonment for being a member of the Hezbollah terrorist organization and was later acquitted, won the compensation lawsuit he filed against the Treasury for being wrongfully imprisoned.
The court ruled that a total of 844 thousand 832 Turkish Lira be paid to Kaçmaz. The compensation was calculated including legal interest to accrue from the date he was taken into custody.
APPELLATE COURT FOUND COMPENSATION AMOUNT EXCESSIVE
Following the ruling in the compensation lawsuit filed by Kaçmaz, the appellate court intervened and overturned the decision, finding the compensation amount to be excessive.
While a new calculation has been requested, it is noted that other acquitted Hezbollah members may also file similar compensation lawsuits.
VAN OPERATION AND JUDICIAL PROCESS
On February 15, 2000, 5 special operations police officers were martyred and 5 organization members were neutralized in an operation conducted against the Hezbollah terrorist organization in Van.
The 11 Hezbollah members captured after the incident were tried at the Van Assize Court. The defendants, who confessed to their crimes in the presence of the prosecutor, were sentenced to aggravated life imprisonment. However, the convicts, who were retried in 2019 on the grounds that they were "not tried fairly," were released and acquitted due to insufficient evidence.
It is known that many Hezbollah members have been released following the rapprochement between HÜDA PAR, known as the political wing of Hezbollah, and the AKP.
