Constitutional debates continue: CHP's Bilgen files criminal complaint against HÜDA PAR Chairman Yapıcıoğlu

HÜDA PAR Chairman Zekeriya Yapıcıoğlu's remarks regarding Article 4 of the Constitution during a program have sparked widespread repercussions.

Yapıcıoğlu's statement, "I said it one by one as if explaining to a fool, yet they insist on not understanding. We say that Article 4 of the Constitution should not exist," has caused reactions in society.

Following these remarks, CHP's Kazım Bilgen filed a criminal complaint with the Istanbul Anadolu Chief Public Prosecutor's Office, requesting that Yapıcıoğlu be prosecuted. Bilgen stated that Yapıcıoğlu attempted to abolish or change the order prescribed by the Constitution and incited the public to hatred and enmity.

Making a statement in front of the courthouse, Bilgen said, "Since the field is empty, someone came out and started talking. Even the amendment of the first four articles of the Constitution cannot be proposed. Who are you? I have filed a complaint against HÜDA PAR Chairman Yapıcıoğlu. We shall see justice served."

'I DEMAND HE BE PUNISHED'

The following points were included in Bilgen's criminal complaint petition;

- The suspect Zekeriya Yapıcıoğlu, who is the Chairman of the Free Cause Party (HÜDA PAR), stated in a program he attended, "I said it one by one as if explaining to a fool, yet they insist on not understanding. We say that Article 4 of the Constitution should not exist. Let me look at the camera and say it again. We say that Article 4 of the Constitution should not exist. Having unchangeable articles in the Constitution does not mean that we should change all the articles you call unchangeable.

We are against Article 4 of the Constitution. Okay, do you understand? Article 4 is placing a mortgage on the will of future generations. Let us sit down and write the other articles together. Not the first 4 articles, just Article 4," thereby committing a constitutional crime. Article 4 of the Constitution of the Republic of Turkey stipulates that the first three articles of the Constitution cannot be changed and that their amendment cannot even be proposed. These articles have placed the fundamental structure and characteristics of the Republic of Turkey under protection.

- Article 4 of our Constitution contains the provision, "The provision in Article 1 of the Constitution regarding the form of the State being a Republic, the characteristics of the Republic in Article 2, and the provisions of Article 3 cannot be changed and their amendment cannot be proposed." The suspect Zekeriya Yapıcıoğlu, who is the Chairman of the Free Cause Party, stated in a program he attended, "We say that Article 4 of the Constitution should not exist. Let me look at the camera and say it again.

"We say that Article 4 of the Constitution should not exist," thereby committing a constitutional crime with his rhetoric against the integrity of our state, the secular order, the republic, and the principles and reforms of Atatürk. This act carried out by the suspect poses a great danger in terms of protecting the constitutional order because it is contrary to the unchangeable provisions of the Constitution. These actions harm the fundamental principles of the Republic of Turkey and create public outrage.

- The suspect Zekeriya Yapıcıoğlu, who is the Chairman of the Free Cause Party, insulted the entire Great Turkish nation, which is respectful of the Constitution and loyal to its nation and state, by calling them "FOOLS" and incited the public to hatred and enmity. For this reason, as a citizen who is respectful of the Constitution and loyal to the principles and reforms of Atatürk, I request that the necessary investigation be initiated against the suspect and that the relevant criminal proceedings be applied in order to protect the constitutional order.

For the reasons explained above, I request that the necessary investigation be conducted against the suspect and that he be punished for the crimes of attempting to abolish the order prescribed by the Constitution or to replace this order with another order or to prevent the actual implementation of this order, defamation, and inciting the public to hatred and enmity."
