Bahar and Nihal Candan (Gülnihal Çiçek), sisters known from the fashion competition "İşte Benim Stilim" and later social media phenomena, along with Hacı İsrafil Sağlam, were detained on November 14, 2023, on allegations of "money laundering" as part of an investigation conducted by the Küçükçekmece Chief Public Prosecutor's Office.

The phenomenon sisters were arrested and sent to prison on November 16, 2023. While the judicial process was ongoing, Nihal Candan contracted anorexia and dropped to 37 kilograms. Nihal Candan, who was hospitalized, was released from prison following a doctor's report stating that her treatment could not be continued in prison.

Candan's release after 5.5 months in prison, having dropped to 37 kilograms, raised the question: "Can a person be released from prison when they lose weight?"

Regarding the issue, legal expert Yurdal Kılıçer spoke to CNN Türk and evaluated Candan's situation. Kılıçer stated, "Release can occur in cases of severe illness, disability, and old age, and if this situation would lead to a life-threatening risk to the individual's health if they remain in prison." Legal expert Kılıçer added, "Upon the request of the person themselves or their lawyers, the detained person is referred to the Forensic Medicine Institute; if a report is obtained from the Forensic Medicine Institute stating that their health condition is not suitable for remaining in prison, they can be released. There is not much of a distinction regarding the crime in this regard."

"AN ARREST WARRANT CAN BE ISSUED BY THE COURT AT ANY MOMENT"

Responding to the question, "Can Nihal Candan go back to prison if she gains weight?", Kılıçer said, "Of course, this right I mentioned is not an irreversible right once applied; that is, it is not a situation that prevents re-arrest or being placed in prison. A period during which the person's health condition can be monitored can be determined in the forensic medicine report. For example, they can be referred to the Forensic Medicine Institute every three months, and a decision can be made again regarding whether their health condition is suitable for prison conditions. In any case, according to the law, it will already be checked once a year by obtaining a report from the Forensic Medicine Institute as to whether their health condition has become suitable for prison conditions. If their condition has reached a point where they can withstand prison conditions, an arrest warrant can be issued by the court at any moment."

In the continuation of his statement, Kılıçer said, "There is no weight limit or specific disease in the law. The criterion is that remaining in prison could lead to a life-threatening risk for the individual. Nihal Candan lost excessive weight because she could not adapt to the conditions in prison. This reached a level that posed a life-threatening risk for her, and the situation was determined by the forensic medicine authorities. The release decision was made for this reason. If she recovers her health and becomes suitable for prison conditions, there is no obstacle to her being re-arrested."
