Evictions to be carried out with 'sufficient' law enforcement

The legislative proposal containing urban transformation regulations has been accepted by the Grand National Assembly of Turkey (TBMM).

The Law on the Transformation of Areas Under Disaster Risk and the Law on Amendments to Certain Laws and Decree-Law No. 375 has been accepted by the TBMM General Assembly.

According to the proposal, new procedures are being introduced through an article to be added to the Administrative Procedure Law regarding cancellation lawsuits filed against administrative actions based on damage assessment reports, excluding transactions related to property rights. Deadlines for conducting site inspections and submitting expert reports are being shortened.

The decision to hold a hearing, even if requested by the parties, is left to the discretion of the court; it is mandated that cases be decided within a maximum of 15 days from the completion of the file or, in cases where interim decisions, site inspections, expert examinations, or hearings are required, from the completion of these processes.

An Urban Transformation Presidency will be established, and the Presidency will have a special budget.

Amendments are being made to ensure that the duties, rights, and powers regarding the identification of risky structures and the allocation of Treasury immovable properties to the Ministry for evaluation will henceforth be exercised by the Urban Transformation Presidency.

SIMPLE MAJORITY WILL BE ABLE TO MAKE DECISIONS

With the proposal, a regulation is being made in the law to provide financial assistance to property owners for construction in order to implement the 'half from us' campaign launched to accelerate transformation in Istanbul.

The decision taken by property owners with a simple majority, along with the proposal containing the terms of the agreement, will be notified to the owners who did not participate in the simple majority decision via a notary or by being announced at the relevant neighborhood headman's office (muhtarlık) for 15 days.

EVICTION BY LAW ENFORCEMENT

The duties and powers granted to the Ministry regarding the restriction of zoning and construction rights during the implementation period in the areas, and the suspension of services such as electricity, water, and natural gas provided to structures in the area, will be exercised by the Urban Transformation Presidency.

In cases where the evacuation of structures within the scope of the law is obstructed, the evacuation will be carried out by sufficient law enforcement upon written authorization from the local administrative authority.

Following the enactment of the proposal, TBMM Deputy Speaker Gülizar Biçer Karaca adjourned the session to reconvene today at 14:00.
