Heavy sentence for person who secretly took photos of colleagues

A person working at a public institution in Samsun secretly took photos under the desks of two colleagues with whom they shared an office in 2018.

Furthermore, while the colleagues were not in the room, the individual copied personal and family photos from their computers and transferred them to their own digital device.

Following the discovery of this situation, a lawsuit was filed against the defendant for the crime of "violation of privacy" in accordance with Article 134 of the Turkish Penal Code. The Samsun 8th Criminal Court of First Instance sentenced the defendant to a total of 12 years in prison, 6 years for each victim.

COURT OF CASSATION UPHELD THE DECISION

While the victims requested that the defendant also be punished for the crimes of "sexual harassment" and "unlawful acquisition or dissemination of data," the defendant appealed the decision, claiming the sentence was excessive. The case was moved to the Court of Cassation.

The 12th Criminal Chamber of the Court of Cassation upheld the 12-year prison sentence handed down by the local court. The decision stated that the trial process was in accordance with procedure and law, and that the defendant's actions were proven. The appeals were unanimously rejected and the verdict was upheld.
