Verdict reached for defendant who murdered and dismembered 23-year-old woman in Esenyurt: He recounted the murder in detail

On June 19, 2024, in Esenyurt, an individual named Fethi Dağlı strangled Erva Raziye Asar, whom he had invited over under the pretext of a job interview, then cut her body into 6 pieces and dumped them at a construction site in Beylikdüzü.

The detained defendant Fethi Dağlı was present at the first hearing held at the Bakırköy 19th High Criminal Court. The victim's mother, complainant Nazik Asar, and father, Hasan Asar, also attended the hearing.

HE RECOUNTED THE MURDER IN DETAIL

In his defense, defendant Fethi Dağlı stated, "I was released from prison in 2022 on probation. I had been working as a security guard at a residential complex in Beylikdüzü for 3-4 months. I posted an ad in a job search group on Facebook. I was earning a commission from this work. I met Erva in this group. I was looking for a woman to clean my house. I met Erva 1 month before the incident. I invited her to clean my house. She came 3 times. Then this incident happened. On the day of the incident, she told me, ‘The people I met before you didn't treat me well, you treat me well, I want to marry you.’ I told her to go to the hospital and get treatment and I refused. She said to me, ‘Aren't you a man? I want to be with you of my own free will.’ She said things to me that were unspeakable. I wanted her to leave the house, and she started throwing things at me. Because she started screaming, I covered her mouth with my hand. Her scarf slipped to her throat. I tightened the scarf. The victim fell to the ground. Then I went outside. I left her in that state. Since I was injured myself, I bought dressing materials," he said.

"I PUT THE BODY IN THE FRIDGE SO IT WOULDN'T DECOMPOSE"

Continuing his defense, the defendant said, "I put the body in the refrigerator at home as a whole so it wouldn't decompose. Then I went to work. The body stayed in the refrigerator at home for 2 days. I dismembered the body 2 days later to get rid of it. I put them in boxes. I left them at the security booth first with the boxes. The body parts stayed in the boxes for 1 night. Then I threw them into the elevator shaft. Her phone stayed with me. Erva's aunt called me. ‘We learned from the police that she last spoke to you, her mother is in very bad condition, is she with you?’ she asked. Since her mother was sick, I couldn't say anything. Her mother also called, and I couldn't say anything to her either. I used Erva's SIM card. Because I felt sorry for her mother's illness, I sent messages as if I were Erva. I even paid her bill. An arm part was found near the construction site. A security guard friend called me and gave me information. I moved that too. I threw the arm part back into the place where the elevator shaft was. The victim's phone was also in the guard booth where I worked; the police took it from there," he said.

SHE WENT TO THE KILLER'S HOUSE FOR A JOB INTERVIEW

The victim's mother, Nazik Asar, stated in her declaration, "She left the house on the day of the incident saying it was a job interview. She went for a job interview, but it turns out she went to this killer's house. Then I called her; she told me once ‘I am far away,’ and another time she said ‘I am coming.’ But her voice was very muffled and dull. She was dealing with this killer. Later, I could not reach my daughter again. The killer later called my daughter's father. He said, ‘She left, I couldn't stop your daughter.’ I am filing a complaint against the defendant who killed my daughter," she said.

The victim's father, Hasan Asar, said, "The defendant messaged my daughter's mother using my daughter's name. At the very beginning of the incident, the defendant opened an account as a woman. He introduced himself to my daughter as a woman. My daughter left the house on the day of the incident to have a job interview," he said.

The public prosecutor, announcing his opinion, requested that the defendant be sentenced to aggravated life imprisonment for the crime of ‘intentional killing against a woman.’ The defendant said, "I agree with the opinion."

Announcing its verdict after the opinion, the court decided to sentence the defendant Fethi Dağlı to aggravated life imprisonment for the crime of ‘intentional killing against a woman.’

FROM THE INDICTMENT

The indictment prepared by the Bakırköy Chief Public Prosecutor's Office described the incident that took place in Istanbul's Esenyurt on June 19, 2024. The indictment noted that Erva Raziye Asar left the house on the day of the incident saying she was going to a job interview, and a complaint was filed after she could not be heard from. Investigations determined that the victim Asar had entered the defendant Fethi Dağlı's house in Hürriyet Neighborhood but had not left. Upon these findings, they went to Fethi Dağlı's house, and the defendant confessed there, saying, "Erva Raziye Asar wanted to have sexual intercourse with me. I did not accept. She said to me, ‘I know what I will do, I will say you are raping me.’ I strangled her with a rope. I took her to the house's bathroom.

After I was sure she was dead, I cut her into pieces with a bread knife. I put them in the freezer at home. After waiting for 1-2 days, I took the dismembered body out in boxes and bags, got into a taxi, and dumped it at a construction site," he said. During the crime scene reconstruction on July 12, it was determined that there were human body parts floating in the elevator shaft inside the construction site.

On the other hand, it was also explained in the indictment that when a security guard who was a friend of Fethi Dağlı from the security booth where he worked said, ‘Citizens in the area say there is a severed human arm,’ the defendant said, ‘This is not our territory, don't get involved, I will handle it.’ It was also stated in the indictment that Fethi Dağlı took the SIM card of Erva Raziye Asar, whom he had killed, inserted it into his own phone, and messaged her relatives as if she were still alive. Furthermore, the cause of death of Erva Raziye Asar was announced by the Council of Forensic Medicine as ‘lack of oxygen due to the application of a ligature to the neck.’

The indictment stated that Erva Raziye Asar went to the defendant Fethi Dağlı's house, it is unknown what happened between them there, and the defendant strangled the victim to death with a rope that could not be recovered, then cut the body into 8 pieces and stored them in a deep freezer. It was also recorded in the indictment that the defendant Dağlı later threw the body parts, wrapped in bags, into the water-filled elevator shaft of the construction site near where he worked as a security guard, and that the parts that surfaced over time were likely carried out of the construction site by stray animals and seen by unidentified persons passing by the scene by chance. It was explained in the indictment that a security guard named Oktay told the defendant, whom he saw as his superior in rank, about the situation, but the defendant prevented Oktay from getting involved in the incident by saying, ‘I will handle it.’ Within the scope of the prepared indictment, it was requested that Fethi Dağlı be sentenced to aggravated life imprisonment for the crime of ‘intentional killing with monstrous feeling and by causing torment.’
