The YENİ Party is preparing to take the decision of the 36th Civil Chamber of the Ankara Regional Court of Justice, which annulled the CHP's 2023 Convention on the grounds of "absolute nullity," to the European Court of Human Rights (ECHR).
Party officials stated that the application should not be viewed merely as an objection concerning the CHP, arguing that the decision creates a violation of rights regarding the internal functioning of political parties and the will of the voters.

The 36th Civil Chamber of the Ankara Regional Court of Justice had annulled the CHP's 2023 Convention with its decision dated May 21, and ruled for the reinstatement of former Chairman Kemal Kılıçdaroğlu to the position of chairman.
A preparation team for the ECHR application was formed at the YENİ Party at the beginning of the week. It was stated that the matter was discussed at the Central Executive Board (MYK) meeting held on Tuesday, and that evaluations regarding the legal process were shared with the party leadership.
"AN APPLICATION FOR TURKISH DEMOCRACY"
The appeal against the decision was taken to the Court of Cassation on July 17, and the 3rd Civil Chamber of the Court of Cassation took the file for preliminary examination on July 26. YENİ Party officials stated that they do not plan to wait for the decision to be issued by the Court of Cassation for the ECHR application.
Arguing that the court decision constitutes interference in the internal order of political parties, the officials assessed that "they have signed a kind of closure decision that regulates the internal functioning of a political party."
On the YENİ Party front, it is stated that one of the fundamental reasons for the application is that the decision produces consequences that concern not only the CHP but all political parties in Turkey. Officials pointed out that such a decision could set a precedent for other parties as well.
Stating that there are different evaluations regarding whether domestic legal remedies need to be exhausted, the officials said that the application will be based on the claim of a violation of rights. Party officials argued that for this reason, the ECHR process will not be conducted with the motivation of "taking back the CHP," but on the basis of voter will and political rights.
YENİ Party officials also expressed that they plan to hold a convention on November 14-15, and that the time required to pass for election eligibility could create a separate debate on the violation of rights in the event of a snap election.
