Court ruling: Istiklal Avenue belongs to the IMM
The Istanbul Metropolitan Municipality (IMM) has won its legal battle against the Ministry of Culture and Tourism and the Beyoğlu Municipality, asserting that "Istiklal Avenue is under the jurisdiction of the Metropolitan Municipality." The court ruled that all authority and responsibility regarding Istiklal Avenue rests with the IMM.
The Istanbul Metropolitan Municipality (IMM) has won another lawsuit, following those concerning Gezi Park, the Khedive Palace, and Kanal Istanbul.
The then-AKP-led Beyoğlu Municipality had prepared an "Istiklal Avenue Facade Arrangement Project" for Istiklal Avenue, which is under the jurisdiction of the IMM, and had received approval for the project from the Ministry of Culture and Tourism.
The IMM initiated a legal battle against the Ministry of Culture and Tourism and the Beyoğlu Municipality, stating that Istiklal Avenue is a main artery and that all authority regarding the avenue belongs to the Metropolitan Municipality.
January 26, 2024: Upon the application of the IMM, the Istanbul 9th Administrative Court issued a stay of execution decision on January 26, 2024.
February 21, 2024: This time, the Beyoğlu Municipality, under the administration of AKP's Haydar Ali Yıldız, intervened. Reviewing the objection of the Beyoğlu Municipality, the Istanbul Regional Administrative Court rejected the Beyoğlu Municipality's application, stating that "the IMM is in the right and the stay of execution decision is in accordance with the law."
"İSTİKLAL WILL EXPERIENCE ITS GOLDEN AGE"
IMM Chief Legal Counsel Eren Sönmez evaluated the legal victory. Sönmez stated, "During the 2019-2024 period, the IMM produced and implemented many projects for Istiklal. In the coming period, many initiatives will be undertaken together with the Beyoğlu Municipality for the golden age of Istiklal. This decision will also form the legal basis for these works."
