UNJUST REPORT

On the day of the incident, a report was prepared based on a one-sided statement provided by the suspect, which did not reflect the truth and attributed the fault to the late courier. Highlighting the injustice, Çimen stated, "At the moment the suspect was released, it was already known by law enforcement that he was 100% at fault."

A BLATANT ESCAPE

Stating that it was understood after reviewing the security camera footage that the suspect was released in plain sight, Çimen said, "Moreover, it is unclear why a temporary residence permit was granted to this suspect, who has no legal status in the country."

FAILURES IN THE JUDICIAL PROCESS

Stating that the judicial process stalled despite medical reports, Çimen expressed that requests for arrest were not evaluated, judicial control measures were not implemented, and the file could not be advanced.

THE PERPETRATOR'S ESCAPE

Emphasizing the necessity of launching judicial and administrative investigations into the failure to prevent the perpetrator from fleeing abroad, Çimen said, "While waiting for the outcome of the trials, we expect those responsible to be punished."

Thanking those who sent messages of support, those who prayed, courier colleagues, and members of the press, Çimen filed a formal notification to the relevant authorities to initiate judicial and administrative investigations.

"I am Lawyer Iyaz Çimen. I am the lawyer for the late Yunus Emre Göçer and his family. We have gathered here today to make our grievances, which emerged following the traffic accident that occurred on Thursday, November 30, 2023, and resulted in death, heard to some extent, and to ensure that others do not suffer the same grievance. My tongue refuses to call what happened an accident. We are here to be the voice not only for the deceased but for all traffic victims regarding this murder, which was committed as a result of a car coming at full speed and hitting the deceased from behind without even braking. Now, I want to tell you what happened on November 30. On Thursday, November 30, around 12:55, my client was taken to the hospital with the news that he had passed away as a result of this murder. In the forensic report written at 13:40, it is clearly stated that the deceased was unconscious, unable to give a statement, and was intubated and taken to intensive care. With the deceased being taken to intensive care, a 6-day struggle for life began, inside for the deceased and outside for his family, loved ones, and all our courier colleagues. At the same time, a traffic accident report was being prepared by two traffic police officers who claimed to be very experienced, based on the one-sided, biased, and untrue statement given by the suspect, whom we later learned was the son of the Somali president, attributing the fault to the deceased. Based on this one-sided statement, the duty prosecutor of the day, around 17:00, unfortunately gave the instruction to take the statement of the perpetrator and release him, despite the fact that the deceased was still in mortal danger, intubated, and fighting for his life in intensive care, and despite the fact that the suspect was not even a citizen of the Republic of Turkey, had a very high risk of fleeing abroad, and it was unclear why he was granted a temporary residence permit. Twenty minutes later, at 17:20, the accident footage, which the whole world has now watched, was reviewed by two police officers on duty at the relevant station, and it was determined that the suspect's statements did not reflect the truth and that the 100% at-fault party in the incident was the son of the fugitive president. Despite this, the perpetrator was released at 18:00 by the same police officers who reviewed the footage, after taking his false statement. Now we understand from this that at the moment the suspect was released, it was already known by law enforcement that he was 100% at fault. Now I ask you;

In this incident; are the traffic police who prepared the accident report based on a one-sided, false statement at fault, or the duty prosecutor who gave the order to release the perpetrator of the deceased, who could not even give a statement despite being intubated, or the law enforcement officers who determined that the fault lay with the perpetrator and yet released the suspect in plain sight?

On the evening of the accident, when we went to the relevant police station, all the staff acted as if they had received instructions, behaving as if they were hearing about the incident for the first time, saying they had no information, and directing us to the team that would arrive the next morning. Subsequently, for 8 days from November 30 to December 7, our arrest requests, which we submitted to the file in writing every day, were not evaluated, no judicial control measures were applied, and unfortunately, no progress could be recorded in the file. On Tuesday evening, December 5, we were given the news of the deceased's passing by the doctors, and subsequently, on Wednesday, December 6, at 9:00 AM, we notified the relevant prosecutor of the death in writing. However, unfortunately, no progress could be recorded again. On December 6, in the afternoon, the deceased was laid to rest, and the type of crime committed turned from negligent injury to negligent homicide. Accordingly, on the morning of Thursday, December 7, we submitted the death certificate to the file in writing and presented our arrest request, which we had been submitting in writing every day. At the same time, our Minister, Mr. Yılmaz Tunç, made a statement following the growing reactions to the issue and stated that the relevant prosecutor's office would do what is necessary. Following this statement, within approximately 24 hours, in our file where no progress had been made for a week despite our daily written arrest requests, a judicial control measure of a travel ban was applied, and in the fault expert report obtained, it was determined that the perpetrator was 100% at fault. I mentioned earlier that law enforcement had already determined that the perpetrator was at fault on the day of the incident at 17:20, before releasing him. Based on the fault report obtained, an arrest warrant was issued for the perpetrator on Friday, December 8, but it was determined that the perpetrator had already fled abroad on Saturday, December 2, on a scheduled flight, walking out freely. Even in a crime with an upper limit of 6 years, the suspect's escape could not be prevented in plain sight. At the point we have reached today, we, like the whole world, are waiting with curiosity to see who will be punished as a result of the trials to be held. Remaining loyal to the oath I took when starting my profession that I would pursue justice to the end, I promise here that we will continue our legal struggle against those responsible for this dark incident until justice is served. I am taking this opportunity to file a notification here to the relevant authorities to initiate administrative and judicial investigations against those responsible for the perpetrator's escape in plain sight. We will defend the rights of the surviving spouse and two orphaned children, one of whom is autistic, to the end, with the motive of preventing potential grievances of others. I would like to thank those who sent us messages of support after the incident, those who stood by us by praying for our struggle, all our courier colleagues who have left all their work aside for over 10 days and have been in the squares shouting in one voice "Justice for Yunus Emre Göçer," and you, the valuable members of the press, who have been the flashlight of our society and have not left us alone from the very beginning."
