The judicial process has concluded in the unfair competition lawsuit filed against Martı TAG by more than ten taxi chambers, primarily the Istanbul Chamber of Automobile Tradesmen and the Antalya Chamber of Drivers and Automobile Tradesmen, which had been ongoing for four years.
The 14th Regional Court of Justice ruled that Martı TAG cannot be banned by a court decision, stating the following: "It is not possible for a court to ban a commercial activity that has not been prohibited by the legislature, nor prohibited or subjected to a license or permit by the relevant administration through secondary regulations based on the authority granted by law."
The court also emphasized that Martı TAG should be evaluated within the scope of the freedom of enterprise guaranteed by the constitution, stating: "Banning a type of activity or subjecting it to a permit or license is primarily within the authority of the legislator and subsequently the administrative authorities. Since no such provision exists, it must be accepted that the activity carried out by the defendant and the platform it established is a result of free and open commercial life and the freedom of enterprise enshrined in the constitution."
The court also drew attention to the gap in the current legislation, noting the need for new legal regulations, and stated: "In accordance with scientific and technological developments and the needs created by the complex structure of urban transportation, there is a need for new legislation regulating urban transportation; the creation of this legislation is a duty belonging to the legislator, and it is legally impossible to issue a decision that would result in the general banning of a type of commercial activity through a court order."
Öktem: "We trusted in the law and our righteousness from the very beginning"
Following the decision, Martı TAG founder Oğuz Alper Öktem stated: "We trusted in the law and our righteousness from the very beginning. The decision rendered today has justified this trust. Martı TAG is now a part of the lives of millions of people. We thank all members of the TAG family who have stood by us and trusted us throughout this process. We will continue to work with the same determination to grow TAG and take it further."
