Important court ruling against traffic fines issued without evidence
A precedent-setting decision has been reached stating that traffic fines lacking photographic or video evidence can be canceled. The court noted that a fine based solely on a statement can be invalidated with a single appeal. Drivers should remember that they can pursue legal remedies within 15 days of receiving a fine.
In Ankara, an administrative fine of 10 thousand liras issued to a driver by a volunteer traffic inspector on the grounds of 'changing lanes in a way that endangers traffic' has been canceled by a court ruling. The court pointed out that there was no photographic or video record in the report presented as the basis for the fine.
The incident in question took place on July 1 on Sakıp Sabancı Boulevard in the Yenimahalle district. While driving his car, a driver named U.Ö. was issued a 10 thousand TL fine by a volunteer traffic inspector under the relevant article of the Highway Traffic Law. In the appeal filed after the fine was notified to the driver, it was emphasized that there was no visual or video evidence regarding the moment of the incident.
The court, referring to the procedures regarding administrative sanction decisions specified in the Misdemeanors Law, noted that the fine to be applied must be supported by evidence such as images. The judgeship ruled for the removal of the administrative fine as there was no concrete evidence in the file.
The lawyer for the driver who filed the application, Özge İrem Aksu, reminded those in similar situations that they can seek their rights by applying to the criminal judgeship of peace within 15 days after receiving the notification. Lawyer Aksu pointed out the importance of clearly stating the legal grounds in the petition of appeal and attaching documents and signs if possible.
This decision has created an important roadmap for drivers who do not have evidence against fines issued by volunteer traffic inspectors.
