Breaking News: Yılmaz Tunç asked about Bahçeli's 'Öcalan' call! Will the terrorist leader be able to benefit from the right to hope?

Minister of Justice Yılmaz Tunç attended a program organized by the Turkey Mediators and Mediation Centers Platform.

Responding to journalists' questions after the program, Tunç made statements regarding the current agenda.

Yılmaz Tunç gave the following response to a question regarding the appointment of Elif Gülşah Gürlek, the wife of Istanbul Chief Public Prosecutor Akın Gürlek—who is leading the investigation into the arrest of CHP Esenyurt Mayor Ahmet Özer—to the Capital Markets Board:

"Our President has an authority derived from the law here. It would not be correct to interpret an appointment made in accordance with our legislation in a different way. It is an appointment that is entirely in accordance with the law and stems from our President's authority."

NARİN GÜRAN MURDER CASE

Making statements regarding the Narin Güran murder case, Tunç said, "All findings are being evaluated along with HTS records." Tunç announced that the court panel has requested an additional report from the expert witness.

Tunç used the following expressions:

"The fact that our child Narin fell victim to a heinous murder deeply wounded us. Technical studies were carried out and evaluated within the scope of the investigation. Based on HTS records, base station records were identified. Technical work regarding narrowed base station records perhaps came to the agenda for the first time. The narrowed base station study is very important evidence. All findings are being evaluated along with HTS records.

Everything will be evaluated by the court in line with the statements. There is the presumption of innocence. It would not be correct to say this person is guilty or that person is innocent. When this investigation began, unfortunately, different evaluations were made in the public eye.

"THE COURT REQUESTED AN ADDITIONAL REPORT"

The court panel requested an additional report from the expert witness. Attention should also be paid to news regarding the stigmatization of individuals during the investigation phase. This is a constitutional right. The investigation was confidential. It was opened to the public after the indictment was prepared. In the process from now on, publications that could negatively affect the trial should be avoided. The court panel is demonstrating meticulous work. It is in an effort to reveal the material truth. The judiciary will find the murderers of our child Narin and give them the punishment they deserve."

ILLEGAL BETTING OPERATION TARGETING CELEBRITIES

Speaking about the 'illegal betting' investigation this morning, which includes Serdar Ortaç, Mehmet Ali Erbil, and numerous social media influencers, Tunç said, "There is an investigation initiated by the judiciary here. There are detentions as a result of this investigation. Individuals will defend themselves. The necessary actions will be taken."

TRUSTEE DEBATES

Minister Tunç noted the following regarding the trustee debates on the agenda:

"Some of our politicians are unfortunately making incorrect interpretations. They are making unfair and insolent criticisms. Let us state this in particular: the Republic of Turkey is a state of law. A state of law does not tolerate the commission of crimes. Therefore, in a state of law, if there is strong suspicion of a crime, the impartial and independent judiciary will of course investigate.

How the practice will be carried out regarding all these local administrators who are under investigation, prosecution, or have been convicted is clear in our legal system.

Article 127 of our Constitution grants authority to the Ministry of Interior. If a crime is committed, there is a provision in our Constitution that the local administrator can be temporarily suspended from duty.

In line with this provision, there is a regulation in articles 45, 46, and 47 of the Municipality Law.

With the regulation made in article 45, there is an authority stating that if there is a mayor against whom an investigation related to terrorism has been opened, the Ministry of Interior can temporarily remove them from office during the investigation phase. The law has granted this authority.

Local administrators must use the authority they receive from the nation as service to the nation. But if you take this authority and abuse it, if you use it in an effort to support terrorist organizations or for their propaganda, then the powers in Article 127 of the Constitution are used in a state of law.

WHY DID THE YSK NOT REJECT THE CANDIDACIES?

In particular, there are investigations that began before the mayors were elected. There are also investigations opened after the mayor was elected. When the Supreme Election Council (YSK) accepts a candidacy, if there is an ongoing investigation, the YSK looks at the criminal record. The YSK does not have the authority to reject a candidacy. When there is a finalized conviction, the mayorship falls, and the Council elects a replacement. There is no finalized judgment here. It is a temporary suspension from duty and a temporary appointment in their place."

DID NOT RESPOND TO BAHÇELİ'S ÖCALAN CALL

Yılmaz Tunç avoided answering a question regarding MHP leader Devlet Bahçeli's call for the 'right to hope' for terrorist leader Abdullah Öcalan.

Minister Tunç left the podium by saying, "Friends, thank you. These are, of course, matters discussed in the TBMM (Grand National Assembly of Turkey), thank you, friends."
