RTÜK decision regarding advertisements
The Radio and Television Supreme Council (RTÜK) has announced that it has decided to initiate a stricter inspection process regarding advertisements due to ongoing violations despite all its warnings.
In a statement issued by the Radio and Television Supreme Council (RTÜK), it was recalled that the Supreme Council regulates and inspects all radio and television stations broadcasting in Turkey within the framework of Law No. 6112 on the Establishment and Broadcasting Services of Radio and Television.
The statement noted that content inspections of radio and television broadcasts are carried out "meticulously and continuously" by Supreme Council experts, and it was recorded that recent examinations revealed violations of the provisions in the legislation regarding both the content and duration of commercial communication broadcasts.
The statement included the following expressions: "As the Radio and Television Supreme Council, although we have made all our good-faith warnings regarding commercial communication broadcasts that constitute a violation of Law No. 6112 from time to time through both press releases and bilateral meetings, it has been determined that our broadcasters have not shown the necessary care in this regard."
MAXIMUM ADVERTISING DURATION THAT CAN BE BROADCAST IN 1 HOUR IS 12 MINUTES
Pointing out that the maximum advertising duration that can be broadcast in a 1-hour time slot is 12 minutes, the statement indicated that some media service providers exceed this duration, thereby both damaging the competitive environment and acting unfairly toward their counterparts who comply with the rules.
Reporting that violations such as increasing volume levels during advertising broadcasts and hidden advertising practices have also been detected, the statement recorded the following:
"Product placement practices are not being carried out in the manner permitted by the law. It has been determined that in product placement practices, the editorial independence of media service providers is interfered with, the renting or purchasing of products or services is directly encouraged, and excessive emphasis is placed on the product. Following these findings, our Supreme Council has decided to initiate a stricter inspection process regarding advertisements.
Acting in accordance with the basic rules mentioned above will be in the best interest of all our broadcasters. Otherwise, we clearly declare that we will not hesitate to use our sanctioning power derived from Law No. 6112."
