New practice in real estate sales: Title deed transactions will not be possible without a lawyer

Minister of Justice Akın Gürlek announced at an iftar program held recently that an important change regarding real estate sales transactions will be brought to the Parliament's agenda. Within the scope of the planned regulation, parties will now be required to be represented by a lawyer in transactions carried out at the land registry office that exceed a certain value.

While more than one million properties changed hands in Turkey last year, the new regulation aims to both increase legal security in real estate sales and expand the professional field for lawyers.

According to Minister Gürlek's statements, it is stated that this new obligation will come into effect in the 12th Judicial Package, which is prepared in line with the goals in the Judicial Reform Strategy Document that has been on the agenda for a long time.

Gürlek stated, "As you know, we have determined our main goals for strengthening the defense in the Judicial Reform Strategy Document. Our president Yasin just mentioned this. I was going to give the good news, but we, God willing, in the 12th package—I have already given the instruction—a legal regulation will also be made, and of course, if our Parliament shows the same will, we are thinking of introducing a mandatory lawyer representation for transactions exceeding a certain amount at the land registry. Look, this is an important process both for ensuring the legal security of transactions and for providing at least a small benefit to our lawyers. I have given instructions to our General Directorate of Law and our General Directorate of Legal Affairs and Legislation on this matter. God willing, in the 12th package, we will introduce a mandatory lawyer requirement at the land registry for transactions exceeding a certain amount."
