A new formula has come to the agenda in the work on the regulation regarding the indefinite alimony practice. According to a report by NTV, in the preparations, which are stated to be expanded upon the instructions of AKP Chairman and President Recep Tayyip Erdoğan, the option of determining the alimony duration according to the economic and social conditions of each case is being evaluated.
It was reported that AKP Group Chairman Abdullah Güler presented a study containing alternatives regarding the alimony regulation at the AKP Central Executive Board meeting. It was stated that at the meeting, Erdoğan pointed out that the issue concerns different segments of society and requested a more broadly participated evaluation.
In this context, it is expected that the prepared text will be reconsidered and that meetings will be held with relevant units of the Ministry of Family and Social Services, academics, and family court judges, primarily with women's associations. It is also stated that reports previously prepared on the subject of alimony will be re-examined.
One of the prominent options in the study is to determine the alimony duration according to the characteristics of the divorce file instead of a uniform application. Accordingly, the duration of the marriage, the age of the person requesting alimony, their health status, whether they work, whether they have an income to support themselves, and their social conditions will be evaluated together.
According to the model on the agenda, the judge will be able to decide how long the alimony will be paid by taking these criteria into account. However, it is stated that the options being worked on have not yet been finalized and that the regulation has therefore been removed from the 13th Judicial Package.
