Gradual retirement proposal in three articles: Regulation for those stuck on age requirements on the TBMM agenda

A new legislative proposal concerning millions of employees seeking gradual retirement has been submitted to the Grand National Assembly of Turkey (TBMM). The proposal, signed by DEM Party Group Deputy Chairs Sezai Temelli and Gülüstan Kılıç Koçyiğit, covers those who were first insured after September 8, 1999.

According to Social Security Institution (SGK) expert İsa Karakaş, the regulation stipulates that a retirement pension shall be granted upon written application to citizens who have completed their insurance and service periods, as well as the required number of premium days, but are unable to retire due to age requirements.

The proposal targets those who remained outside the scope of the EYT (Retirement Age Victims) regulation and began working under the SGK or the Pension Fund (Emekli Sandığı) after September 8, 1999. Karakaş stated that the changes made to the retirement system since 1999 have created significant disparities among employees.

THE THREE ARTICLES OF THE PROPOSAL

The first article proposes adding a "Temporary Article 113" to the Social Insurance and General Health Insurance Law No. 5510. Accordingly, those who were first insured under SSK, Bağ-Kur, Agricultural SSK, or the Pension Fund after September 8, 1999, will be able to retire without an age requirement, provided they fulfill the necessary duration and premium conditions.

The second article stipulates that if the proposal is enacted, it will enter into force on the day it is published in the Official Gazette. This article aims to ensure the implementation begins without delay.

The third article states that the President will be responsible for the execution of the provisions of the law. Thus, the administrative responsibility for the implementation of the regulation is also defined in the text of the proposal.

Whether the proposal will be enacted will become clear following the committee and General Assembly processes in the TBMM. If the regulation is accepted, a new application path will be opened for a large segment of the population waiting for retirement due to age conditions.
