The debate over whether artificial intelligence can be a true inventor has been partially resolved. US officials have decided that while artificial intelligence can be used during the discovery process, an AI cannot be a patent holder.

Artificial intelligence, which has become widespread in recent years, is used in many fields. When used correctly, it is even possible to make new discoveries with AI. However, even in this case, accepting AI as an inventor remains controversial. The United States Patent and Trademark Office (USPTO) has reached an important decision on this matter.

The debate began with a decision made by the USPTO in 2020. A researcher named Stephen Thaler listed an AI as an inventor for a study he conducted. However, the USPTO did not accept this because an inventor could only be a real human being. When the case was taken to court, the court upheld the USPTO's decision. Another court also ruled that copyright cannot be granted to artificial intelligence systems.

Following a series of public hearings, the USPTO published new guidance and issued a decision regarding the use of artificial intelligence during new discoveries. Accordingly, an AI cannot be recognized as an inventor, but an individual can receive support from AI during a discovery. However, according to the USPTO, the individual filing the patent application must include this information in the documents submitted. Furthermore, for an individual who receives support from AI to be recognized as an inventor, that person must have made a significant contribution to the discovery. In other words, not every discovery made with AI may make the user an inventor.
