In his statement, Şamil Tayyar described the situation as 'a great pity' and wrote the following:

An indictment has been prepared against him on charges of 'publicly inciting hatred and enmity.'
A prison sentence of 1-3 years is being requested.
It is a sentence without actual jail time; even if he is convicted, it is highly likely to be converted into a fine or suspended.
Can there be an arrest in such a case?
When you consider those who have not spent a single day in prison despite receiving sentences of more than 4 years, it is truly a very sad situation.
