Regulation on stray animals at the Constitutional Court: First review to be held tomorrow
The Constitutional Court (AYM) will conduct its first review tomorrow regarding the lawsuit filed for the annulment and stay of execution of certain provisions of the Law on Amendments to the Animal Protection Law, which includes regulations concerning stray animals.
The High Court has included the annulment lawsuit, filed by the CHP on August 15 regarding the law that entered into force after being published in the Official Gazette on August 2, on the agenda of tomorrow's General Assembly.
The Constitutional Court will conduct its first review of the case during its meeting tomorrow. If no deficiencies are found in the application, the case will be heard on its merits on a date to be determined later.
The High Court, which could also make a decision on the request for a stay of execution during tomorrow's meeting, may also decide on this request during the merits phase.
ANNULMENT OF 16 OUT OF 17 ARTICLES HAD BEEN REQUESTED
Following the entry into force of the law, the CHP had applied to the Constitutional Court for the annulment and stay of execution of 16 of the law's 17 articles.
Making a press statement in front of the High Court after the application, CHP Group Deputy Chairman Gökhan Günaydın argued that the articles they requested to be annulled were entirely contrary to animal rights, public interest, the fundamental aims and duties of the state, the right to life, the right to the environment, the principle of protecting natural assets, and the effect of international agreements on domestic law.
