Pointing out that Kaya transferred her Özata Denizcilik shares one day before the Capital Markets Board (SPK) liquidation decision and that the payment was made on the same day, Tayyar found the prosecutor's assessment regarding insider information to be well-founded. However, Tayyar stated that the findings regarding the irregularity in question were already present in TERA and SPK records previously, and said that public officials who had negligence or intent in the past should also be investigated.
New developments continue to occur in the fund investigation on Turkey's agenda. A significant stage has been reached in the file following the testimonies given to the prosecutor's office by former Minister of Family and Social Services Fatma Betül Sayan Kaya, her husband İlyas Kaya, and former Capital Markets Board (SPK) Chairman İbrahim Ömer Gönül.
Following the testimony procedures that lasted approximately 9 hours on November 5, Fatma Betül Sayan Kaya was referred to the court with a request for arrest on charges of "being a member of an organization established to commit crimes" and "violation of the Capital Markets Law." Judicial control was requested for İlyas Kaya and former SPK Chairman İbrahim Ömer Gönül.
TAYYAR DREW ATTENTION TO THE DETAILS IN THE REFERRAL DOCUMENT
Following the developments, former AKP deputy Şamil Tayyar evaluated the accusations against Sayan Kaya and the findings in the referral document submitted by the prosecutor's office to the court in a statement on his social media account.
Tayyar drew attention specifically to the date the Özata Denizcilik shares were transferred and the payment method.
According to the information in the prosecutor's referral document, Sayan Kaya transferred her shares on September 16, one day before the SPK's liquidation decision. It was stated that in the transaction, which should normally have a two-day clearing period, the shares were taken over by TERA via transfer and the price was paid on the same day.
Recalling that this transaction was evaluated by the prosecutor's office as having been carried out with insider information, Tayyar stated that he found this determination to be correct and appropriate.
“IT HAD ALREADY BEEN IN TERA AND SPK RECORDS”
The most striking part of Şamil Tayyar's statement was his assessment that the transactions in question were already known.
Tayyar stated that the close relationship between TERA executives Emre Tezmen and Erdin Özel and Sayan Kaya had also entered the investigation file.
However, saying that there is a detail that should not be overlooked here, Tayyar argued that the findings regarding the irregular transaction in question were already in TERA and SPK records.
Tayyar stated that it is known that a criminal complaint was filed with the SPK regarding this transaction from within TERA as well.
“PUBLIC OFFICIALS WITH NEGLIGENCE OR INTENT MUST ALSO BE HELD ACCOUNTABLE”
In his statement, Şamil Tayyar emphasized that the investigation should not be limited only to the allegations and transactions that have emerged today.
Pointing out that it should also be investigated whether the necessary actions were taken despite the fact that the irregularity in question had previously entered the records of the relevant institutions, Tayyar demanded that public officials who had responsibility in the past period also be scrutinized.
Tayyar concluded his statement with the following expressions:
“Public officials who had negligence or intent in this matter previously must also be held accountable.”
This move by Tayyar brought to the agenda that not only investment transactions but also whether the allegations regarding these transactions had reached the relevant institutions before and the responsibility of the institutions in this process should also be discussed in the fund investigation.
