Competition Authority fines 9 cosmetics companies

The Competition Authority has concluded its investigation into 9 cosmetics companies. The authority has imposed various administrative fines on the 9 companies. 

It was stated that the highest fine was 7.9 million TL.

The statement made by the Competition Authority is as follows;

"It has been decided to conclude the investigation conducted regarding Ayaz ve Ortakları Ltd. Şirketi concerning the allegation of participation in a hub-and-spoke cartel with the Board decision dated 13.04.2023 and numbered 23-18/343-M(3) through a settlement, and to impose an administrative fine of 1,083,338.41 TL on the undertaking,

It has been decided to conclude the investigation conducted regarding SB Grup Kozmetik Anonim Şirketi concerning the allegation of participation in a hub-and-spoke cartel with the Board decision dated 13.04.2023 and numbered 23-18/343-M(3) through a settlement, and to impose an administrative fine of 184,675.76 TL on the undertaking,

It has been decided to conclude the investigation conducted regarding Easyvit Sağlık Ürünleri Sanayi AŞ concerning the allegations of fixing the resale prices of resellers and restricting internet sales with the Board decision dated 13.04.2023 and numbered 23-18/343-M(4) through commitments regarding behaviors aimed at restricting internet sales; and through a settlement regarding the allegation of fixing the resale prices of resellers, and to impose an administrative fine of 1,217,437.18 TL on the undertaking, 

It has been decided to conclude the investigation conducted regarding ELCA Kozmetik Limited Şirketi concerning the allegations of fixing the resale prices of resellers and restricting internet sales with the Board decision dated 13.04.2023 and numbered 23-18/343-M(5) through commitments regarding behaviors aimed at restricting internet sales; and through a settlement regarding the allegation of fixing the resale prices of resellers, and to impose an administrative fine of 7,909,453.64 TL on the undertaking, 

It has been decided to conclude the investigation conducted regarding Farmatek İç ve Dış Tic. AŞ concerning the allegations of fixing the resale prices of resellers and restricting internet sales with the Board decision dated 13.04.2023 and numbered 23-18/343-M(6) through commitments regarding behaviors aimed at restricting internet sales; and through a settlement regarding the allegation of fixing the resale prices of resellers, and to impose an administrative fine of 2,716,256.69 TL on the undertaking, 

It has been decided to conclude the investigation conducted regarding Glohe Bitkisel Ürünler San. ve Tic. AŞ concerning the allegations of fixing the resale prices of resellers and restricting internet sales with the Board decision dated 13.04.2023 and numbered 23-18/343-M(7) through commitments regarding behaviors aimed at restricting internet sales; and through a settlement regarding the allegation of fixing the resale prices of resellers, and to impose an administrative fine of 925,805.74 TL on the undertaking, 

It has been decided to conclude the investigation conducted regarding L'Oreal Türkiye Kozmetik San. ve Tic. AŞ concerning the allegations of fixing the resale prices of resellers and restricting internet sales with the Board decision dated 13.04.2023 and numbered 23-18/343-M(9) through commitments regarding behaviors aimed at restricting internet sales; and through a settlement regarding the allegation of fixing the resale prices of resellers, and to impose an administrative fine of 87,387,007.53 TL on the undertaking, 

It has been decided to conclude the investigation conducted regarding Rebul JCR Kozmetik Pazarlama AŞ concerning the allegation of fixing the sales prices of its resellers with the Board decision dated 13.04.2023 and numbered 23-18/343-M(11) through a settlement, and to impose an administrative fine of 5,357,950.92 TL on the undertaking, 

It has been decided to conclude the investigation conducted regarding Sistem Kozmetik San. ve Tic Ltd. Şti. concerning the allegations of fixing the resale prices of resellers and restricting internet sales with the Board decision dated 13.04.2023 and numbered 23-18/343-M(12) through commitments regarding behaviors aimed at restricting internet sales; and through a settlement regarding the allegation of fixing the resale prices of resellers, and to impose an administrative fine of 1,784,584.28 TL on the undertaking."
