First statement from Can Atalay's lawyer: 'There is a judicial coup'
The 3rd Criminal Chamber of the Court of Cassation has once again rejected the request to stay the proceedings against Can Atalay, who was elected as a deputy from the Workers' Party of Turkey (TİP). Atalay's lawyer, Özgür Urfa, stated, "There is a judicial coup. The HSK (Council of Judges and Prosecutors) will either do what is necessary or become an accomplice to the crime."
The 3rd Criminal Chamber of the Court of Cassation has decided that the second violation ruling by the Constitutional Court has no legal value and that the ruling should not be complied with.
The 3rd Criminal Chamber of the Court of Cassation stated that the second violation ruling issued by the Constitutional Court regarding Şerafettin Can Atalay has no legal value, and in this context, there is no ruling that can be implemented under Article 153/6 of the Constitution, thereby deciding not to comply with the Constitutional Court's ruling.
The Chamber expressed that the ruling in question was an act of juristocracy (Juristocracy, rule by judges. Contrary to democracy, it defines the formation of an oligarchic administration by judges and carries a critical meaning).
Atalay's lawyer Özgür Urfa evaluated this decision during a live broadcast on Halk TV.
'THEY SHOULD LOCK THE DOORS OF THE COURT'
Urfa stated, "There is a judicial coup. The HSK will either do what is necessary or become an accomplice to the crime. The members of the Constitutional Court should take off their robes and say that they will not perform their duties until the ruling is implemented. They should lock the doors of the court. The Court of Cassation has already locked that door. The members of the Constitutional Court should physically and effectively hang their robes on that door; otherwise, their own existence has effectively come to an end as of this moment."
