Critical directive from Erdoğan: Details of the framework law begin to emerge

Details regarding how the process will function if the Draft Law on Strengthening National Solidarity and Social Integration, submitted to the TBMM, is enacted have begun to emerge. It is stated that approximately 3,900 people who were convicted solely of membership in an organization before June 1, 2005, and who do not have a life sentence, could benefit from the regulation.

It is reported that the proposal was submitted to Parliament with the signatures of AK Party, MHP, DEM Party, and CHP deputies. The regulation will enter into force after being accepted by the TBMM General Assembly and published in the Official Gazette. However, for actual implementation, the dissolution of the PKK/KCK must be finalized and this situation must be announced in the Official Gazette by a decision of the National Security Council (MGK).

DURATION WILL BE LIMITED TO 6 MONTHS

According to information reflected in the press, a "confirmation and detection mechanism" will be activated after the organization members lay down their arms. It is anticipated that MIT Undersecretary İbrahim Kalın will present a report to the National Security Council, and the MGK will confirm the disarmament process.

Following this stage, the implementation period will begin with a Presidential Decree to be published with the signature of President Recep Tayyip Erdoğan. It is stated that the process will be limited to 6 months, and after the completion of security procedures, the return of 100 people each from Northern Iraq and Europe is planned in the first stage. It is noted that entries will be permitted in groups of two or three.

WHO WILL BE EXCLUDED FROM THE SCOPE?

It is noted in the proposal that investigations and lawsuits regarding intentional homicide crimes committed within the scope of organizational activity, as well as crimes committed before June 1, 2005, that require life imprisonment or aggravated life imprisonment, are kept outside the scope. For this reason, it is stated that approximately 814 people currently in prison will not be able to benefit from the regulation.

Among those who will not be able to benefit from the regulation are high-level executives of the organization, including Abdullah Öcalan, as well as Murat Karayılan, Cemil Bayık, Duran Kalkan, Sabri Ok, and Bese Hozat. It is stated that the number of people in this group is approximately 200.

For the coordination of the implementation, it is planned to establish an Evaluation and Coordination Board chaired by the Vice President. It is reported that the Board will include the Presidential Secretary General, the MIT Undersecretary, and the Ministers of Justice, Interior, National Defense, and Family and Labor. A commission will also be established within the TBMM to monitor the process.

According to a report by Türkiye Gazetesi, President Erdoğan instructed the organization during the AK Party MKYK meeting to explain the process correctly to the public and not to leave room for disinformation. It was reported that AK Party organizations will take to the field starting in September with the identified names to explain the process to the citizens.
