CMB'S FUND LIQUIDATION PROCESS

The Capital Markets Board (CMB) had decided on the liquidation of a total of 131 funds belonging to 7 portfolio management companies as part of its decisions dated September 17. According to the records of the Central Securities Depository, there are 455 thousand 758 unique investors in these funds.

The procedures and principles regarding the liquidation transactions were also determined in the CMB's bulletin numbered 2026/61. Türkiye İş Bankası was assigned for the liquidation process of the funds founded by Tera Portföy Yönetimi AŞ, while Ziraat Bankası was assigned for the funds established by A1 Capital, Atlas, Bulls, Hedef, Pardus, and Pusula Portföy. The Board later extended the maximum period foreseen for liquidation from 3 months to 6 months.

In a statement made on September 28, the CMB announced that payments would be made to the holders of instructions that were canceled due to the closure of the funds to transactions via TEFAS, in proportion to their participation share ownership in the fund from the liquidation balance.

It is stated that individuals against whom a criminal complaint decision has been made under the Capital Markets Law No. 6362 can benefit from effective remorse provisions if they make payments related to the benefits obtained under the determined conditions. The CMB bulletin also included the procedure for making these payments to the Ministry of Treasury and Finance's e-collection account.
