Expert report in Eyüp Can case: Fall may have occurred due to frontal pressure

The long-awaited expert report regarding the death of 12-year-old Eyüp Can Güner, who was found dead in a shopping arcade in the Anamur district of Mersin, has been submitted to the case file. The report concluded that the injuries that caused the child's death were consistent with a fall from a height and impact with the ground, and that the fall may have occurred due to pressure applied to the front of the upper body.

The incident occurred on July 29, 2025, at the Osman Sinanoğlu Arcade on Atatürk Boulevard in the Saray neighborhood. It is alleged that N.U. chased Eyüp Can Güner, who worked at a doner kebab shop; the child disappeared from sight after running toward the arcade street. When he did not return to work, employees searched for him and found Eyüp Can motionless on the ground floor of the arcade. Medical teams determined that the child had lost his life.

An autopsy determined that Eyüp Can died as a result of head trauma, bone fractures, lacerations, and internal organ injuries. N.U., who was taken into custody, was arrested and sent to prison on charges of "causing death by negligent conduct." It was stated that security camera footage captured the moments the child was walking on the street and subsequently fleeing during the chase.

Eyüp Can's family, relatives, and lawyers for both parties attended the 4th hearing of the case held at the Anamur High Criminal Court. The defendant, N.U., joined the hearing via SEGBİS. The defendant reiterated his previous statements, claiming that he did not see the child in the arcade.

WHAT DID THE REPORT STATE?

The expert report read during the hearing stated that Eyüp Can Güner fell from a height of approximately 4 meters from the ground-level entrance of the business center; he first struck the upper part of a sign leaning against the pool on the ground floor with his left armpit and torso, and then hit the tiled concrete floor head-first.

The report stated that there was insufficient medical evidence to indicate that the death was caused by a sharp or penetrating object injury. Furthermore, it was noted that a fall from 4 meters onto a concrete floor would not produce a mere "clicking" sound, but rather a loud noise in the range of approximately 90-100 decibels.

It has been assessed that Eyüp Can Güner's rapid fall from a height of 4 meters from the ground-level entrance of the business center, with his back turned to the inside of the building, in 2.8 seconds, could only have occurred due to pressure applied to the front of his upper body.

The court panel granted the parties time to submit their statements regarding the report. The hearing was adjourned until October 15.

Speaking after the hearing, the mother, Güllü Can, argued that the report proved her son was "pushed and killed by the defendant" and demanded that the defendant be punished to the fullest extent of the law.

The plaintiff's lawyer, Gurbet Bilbay, also stated that Eyüp Can was 1.50 meters tall while the railing was 90 centimeters high, noting that the expert report indicated it was impossible for the child to have fallen without external pressure. Recalling that the defendant had previously claimed to have heard a "clicking" sound, Bilbay stated that the report emphasized that the fall of a 50-kilogram child would have produced a much louder sound.
