Legal experts warn! You could get into trouble because of emojis

Emojis, which we use frequently in our daily lives, have begun to occupy an important place in legal processes. Tevfik İmamoğlu, a lawyer from the Kayseri Bar Association, stated that emojis can be the subject of crimes such as threats, insults, and sexual harassment.

İmamoğlu said, "Emojis are being integrated into the law rapidly. For example, in Canada, adding a 'thumbs up' emoji to a sales offer was considered an acceptance. In the US, emojis such as a pistol or a fist have been viewed as threats."

PRECEDENT-SETTING RULING IN DİYARBAKIR

A recent court ruling in Diyarbakır has highlighted the legal consequences of emojis. The Diyarbakır 7th Criminal Court of First Instance convicted a defendant of sexual harassment for sending heart and kiss emojis to someone they did not know. The court evaluated this situation as the facilitation of a crime through electronic communication.

İmamoğlu warned, "Although it is accepted in Turkish law that emojis do not constitute a crime on their own, they can constitute a crime when combined with the intensity of the action and other evidence. We will see more cases involving emojis in the future. I advise our citizens to use emojis carefully and to act in accordance with the law in private messages."
