Will the audio recording in the Narin Güran murder case change the course of the trial?
Statements from 6 people, two of whom are listed as "suspects," have been added to the case file regarding allegations that the Güran family offered to have the detained defendant Nevzat Bahtiyar, who confessed to hiding Narin Güran's lifeless body in a stream in Diyarbakır, "take the blame."
Narin Güran, who went missing on August 21 in the Tavşantepe neighborhood of the central Bağlar district and whose lifeless body was found in the Eğertutmaz stream on September 8, was murdered. Her uncle Salim, mother Yüksel, and brother Enes Güran, along with their neighbor Nevzat Bahtiyar, are being tried for "intentional killing of a child in complicity," facing life imprisonment with aggravated circumstances.
On November 11, Nevzat Bahtiyar's son, İbrahim Bahtiyar, filed a petition with the Diyarbakır Chief Public Prosecutor's Office, alleging that "the Güran family, through an intermediary named Hasan K., requested that his father take the blame for the crime in exchange for a house and the transfer of a vehicle belonging to his uncle, which was registered under the Güran family's name." Bahtiyar also submitted an audio recording of a phone conversation he had with Hasan K. regarding this claim to the Chief Public Prosecutor's Office.
Following this, the audio recording was transcribed and a report was prepared.
Regarding these allegations, statements were also taken on November 28-29 by the Provincial Gendarmerie Command from Hasan K. (65) and Ali Rıza Güran (65), the uncle of the detained defendant Salim Güran, in the capacity of "suspects," while statements were taken for "informational purposes" from Nevzat Bahtiyar's wife Gazal (46), his sons İbrahim (20) and Ferhat Bahtiyar (24), and his daughter Fadile N. (27).
PHONE CONVERSATION RECORDS:
The phone conversation, which began with the allegation that Hasan K. told Ali Rıza Güran to convey to the Bahtiyar family, "If he says 'I did it,' we would bring their houses, we would give Gazal's house to Gazal. Can you tell them? I cannot tell them myself," continued as follows:
Gazal Bahtiyar: "You should have said, 'There is a fool in front of you.' Let them do it, pin it on him, give the house to Gazal. I would sacrifice him for Nevzat. Would I be deceived by worldly goods? They demolished Nevzat's house, they set fire to his house."
Hasan K: "I said the children told me, 'Let them give us the transfer of our car.' (The Güran family) The younger brother said, 'Okay, the car transfer is not an issue. We will give it when the time comes.'"
Gazal Bahtiyar: "They killed her themselves, they killed their daughter, and they put it on our man's neck. Then they send an offer."
Hasan K: "They told me, and I said I would tell you."
Gazal Bahtiyar: "Tell them to watch their step, don't say words to me, uncle. They left this poor man to rot in prison."
Hasan K: "What can I say, may God not let your rights go unpunished."
Gazal Bahtiyar: "Amen. This poor man knew nothing about anything, uncle, I was at home. He came, ate his meal, left, watered his trees, whatever he did, he pinned it on him."
Hasan K: "The crime is his, Nevzat deserves death. Why did Nevzat take the bodies and hide them? He should have said, 'Why am I hiding it?'"
Gazal Bahtiyar: "They threatened him, uncle, would he have gone if they hadn't threatened him?"
Hasan K: "When he went; when his first week was over, when he was arrested, he should have gone and said, 'They forced me to do it.' He wouldn't have gone to jail."
Gazal Bahtiyar: "Don't let Hacı Rıza (Ali Rıza Güran) send their offers."
Hasan K: "If they send word, you can say 'no'."
İbrahim Bahtiyar (Nevzat Bahtiyar's son): "Uncle, you tell them, whatever the state says, that is it. Weren't they the ones saying 'whatever the state says, that is it'? The state will reveal it."
Hasan K: "Whoever it is, the state will reveal it. I am between the houses, people are around me, I cannot talk much."
STATEMENTS OF 6 PEOPLE TAKEN
In his statement to the gendarmerie, Nevzat Bahtiyar's son, İbrahim Bahtiyar, stated that his sister Fadile N. came to his brother Ferhat's house on October 27.
Bahtiyar alleged that his sister Fadile N. told them in the room where he and his mother were present that "Ali Rıza Güran called Hasan K. to his side and said, 'Nevzat already killed Narin, let him accept the crime, let his children come to his house in the village, we will still look after them, we will support them. Let Nevzat take the blame, let our children get out, and you go and convey this to Gazal and her children.'"
Stating that Hasan K. first conveyed this to his aunt Gülbahar K., and that Gülbahar K. told the matter to her sister Fadile N. by phone, Bahtiyar noted the following:
"When she relayed these that day, before Fadile left us, at 19:07, we called Hasan K. from the mobile phone number used by my brother Hakim Bahtiyar. I put the phone on speaker so that those present could hear. My mother Gazal started talking. After asking how he was, she asked if there was a money offer. He told us, 'Ali Rıza Güran called me today, he called me to the village. I went to the village and met with Ali Rıza. He made me an offer saying, 'Nevzat already killed her, everything is clear, it's obvious. Let him accept his crime. Let his children come to the house in the village again, we will look after them, we will support them if necessary.' My mother Gazal said, 'Are they going to deceive me with a house? They ruined my husband's life, let them go and rot in prison, let my husband get out. They should definitely not make such an offer to us. Is Ali Rıza offering us a house? We do not accept it.' Hasan K. then said, 'I am reporting to you what was conveyed to me.' Then I started talking. 'There is a court case. The state will reveal everything,' I said."
Nevzat Bahtiyar's son, Ferhat Bahtiyar, also claimed in his statement that Hasan K. conveyed to them Ali Rıza Güran's offer: "Let them return to the village, we will give them their house, we will meet whatever material and moral needs they have. Let Nevzat take the blame for this incident, he did it anyway."
Nevzat Bahtiyar's daughter, Fadile N., alleged that on October 27, around 18:00, her aunt Gülbahar K. called her via WhatsApp and conveyed Ali Rıza Güran's offer, saying, "I couldn't bring myself to do it, let me call them, you tell them."
Fadile N. stated that Hasan K. told her aunt, "Ali Rıza Güran called me to his house. He said, 'Nevzat did this incident. Our family has been disgraced. Let Nevzat take the blame. Let his children return to their house, we will look after them, we will meet whatever needs they have.'" She stated that upon her aunt telling her this, she went to the house where her mother and siblings lived and explained the situation to them.
Nevzat Bahtiyar's wife, Gazal Bahtiyar, also stated in her testimony that her daughter Fadile N. came to their house and stated that an offer had been made to them through Hasan K., saying:
"We called Hasan K. and asked if such an offer existed. Hasan K. said that Ali Rıza Güran called him to the Tavşantepe neighborhood and said, 'Go tell his family, let Nevzat take the blame. We will bring his family back to the village. We will meet all their needs. Let this incident be closed.' I said that I would never accept such an offer, that I did not believe Nevzat killed Narin, that I would not be deceived by money, that I would not trade Nevzat for the world, and that he should not make such an offer again."
Hasan K., whose statement was taken in the capacity of a suspect, stated that the wives of Nevzat Bahtiyar and Salim Güran were from their village and that they were relatives.
Stating that Ali Rıza Güran and Hüseyin Güran were his peers and that he knew them, Hasan K. said he was in Yalova when Narin went missing.
Stating that while he was there, Narin's body was found, and that he returned to Diyarbakır from Yalova upon this, Hasan K. noted the following:
"They were sitting as a family in front of Hüseyin Güran's house. I sat next to Ali Rıza Güran. Ali Rıza said, 'If ours did it, may God damn him.' Then Ali Rıza asked me, 'Who do you think did this?' I said, 'The state has intervened, it will find it, but my guess is that Enes did this, and Salim got into trouble while cleaning it up.' As Ali Rıza was seeing me off, he said to me, 'Nevzat's wife and Salim's wife are your daughters. Tell Nevzat, if he did it, let him say he did it. Tell his children, his wife, to come to their houses, we will not interfere with them. We will look after them, we will help them, we will not harm them.' Later, I returned to the Batıkarakoç neighborhood. I saw Gülbahar K. there. I told her what Ali Rıza Güran had conveyed. I said, 'I will not tell this to Gazal, you tell her if you want.' On the evening of the same day, Gazal called me from her son's number and spoke as if, 'I do not accept land or a house. How can Ali Rıza say such a thing?' I told Gazal what I had told Gülbahar. Then, when I said, 'Don't lie, the man didn't say land or house,' her son İbrahim said, 'Uncle, we will report you to the prosecutor's office, you will be written down as a witness.' I said, 'I do not lie. Do not bother me with the prosecutor's office.'"
ALİ RIZA GÜRAN DID NOT ACCEPT THE ALLEGATIONS
Ali Rıza Güran, whose statement was taken in the capacity of a suspect, also claimed that "after baseless allegations and news appeared on television that Salim Güran had an affair with the wives of Arif and Hüseyin Güran," Hüseyin Güran said to him, "They are messing with our honor. Go tell Nevzat's wife not to bring up this issue and disgrace us further."
Stating that he wanted to meet with M.K., who is Gazal Bahtiyar's uncle, but could not reach him on his mobile phone, he called his relative Hasan K., and Güran said the following:
"I said, 'Hasan K., my request from you is that you go and tell them not to bring up our honor again, to remove this issue.' Apart from this, no other subject related to the incident was discussed. Then Hasan K. said to me, 'I have a request from you. Nevzat Bahtiyar's brother bought a vehicle from your nephew İ. Güran but could not get the transfer. I request help regarding the transfer.' I said, 'Your request is on my head, but what you are asking for will happen in the future.' The conversation ended this way. Apart from this, I absolutely do not accept the allegations made. A few days later, when we saw the baseless allegations regarding this on social media and national media, we filed a criminal complaint with the Diyarbakır Chief Public Prosecutor's Office."
