Constitutional Court;
- Annulled the provision regarding the operation of notaries on holidays and during off-hours, to take effect after 9 months.
- Also annulled the provision in Article 226 of the Criminal Procedure Code stating, "If notification cannot be made to the defendant's last known address in the file, or if the defendant does not appear at the hearing despite notification, notifications made to their defense counsel shall be deemed sufficient." In its annulment decision, the high court emphasized that the right to defense must be provided to the defendant personally in order to ensure a trial consistent with equity.
By a decision of the Grand National Assembly of Turkey (TBMM), the Joint Commission composed of the Constitutional and Justice Commissions, where parliamentary immunity files are reviewed, and the Constitutional Commission will not take a break from their work and will not go on recess.
The Council of Ministers Decision dated 30/12/2005 and numbered 2005/9916, which regulated the revenue shares transferred to the treasury from certain state-owned economic enterprises (KİT), has been repealed. The repeal will be applied retroactively, effective from June 1, 2026. The regulation in question required the relevant state-owned enterprises to transfer a certain share of the income they generated to the central budget.
Amendments were made to the Regulation on the Investor Compensation Center, updating provisions regarding the return of assets subject to the statute of limitations and the duties of Takasbank. Refund applications for assets subject to the statute of limitations will now be made via e-Devlet. Investment firms will send the list of assets and receivables that reached the statute of limitations in the previous year to both the Investor Compensation Center and Takasbank. For receivables in brokerage firms under the Special Fund that had not obtained an insolvency certificate or been registered in the bankruptcy estate by the end of 2014, the statute of limitations will be considered to have expired before 22/4/2021.
Amendments were made to the Regulation on Excavation Support Structures, which entered into force in 2022 and determines the analysis, design, and implementation criteria for excavation support structures and deep excavations. With the amendment, regulations regarding calculations and applications for hybrid excavation support structures were introduced, and definitions regarding shoring structures were clarified.
With the amendment made to the Communiqué on the Implementation of Surveillance in Imports, provisions regarding the use of registration certificates were changed. According to the new regulation, imports can be made even if the value determined by customs during the registration of the customs declaration exceeds the value stated in the registration certificate by up to 5%.
With the amendments made to the Regulation on the Incentive for Constructing New Ships to Replace Scrapped Turkish-Flagged Ships, the definition of contractor was expanded, a registry requirement was introduced for the scrapped ship, and the minimum tonnage of the ship to be newly constructed was determined. Accordingly, the gross tonnage of the newly constructed ship was set at at least half of the scrapped ship if it is 12,000 GT or larger, and at least one-third if it is smaller than 12,000 GT.
